I, James Middaugh of the State of Kentucky and county of Greenup, being weak in body but of sound and perfect mind and memory, blessed by Almighty God for the same, do make and publish this my last will and Testament in manner and form following that is today. First I give and bequeath unto my beloved wife, Susannah Middaugh forty-five acres of land, lying in the State of Kentucky and county aforesaid together with all appurtenances there unto belonging, it being the place where I now live. Also all my estate being and lying in the State of New York and County of Tioga, it being in land, the quantiy not known(Elias, his father, died in 1819 in Tioga), also all my goods and chattels which I now hold and possess, first paying all my burial expenses, and all my just debts, to have and to hold so long as she remains my widow and no longer, and then to be equally divided between the heirs of my natural body to wit, CHARLES MEDAUGH, JAMES MEDAUGH, JOHN MEDAUGH, ELIZA MEDAUGH, BIRD (prob. Elias Bird, another connection to Elias of NY) MEDAUGH, BENJAMIN MEDAUGH, SALLY ANN MEDAUGH, SUSANNAH MEDUGH, ALMIRA (MIDDAUGH) JOHNSON, MELILA (MIDDAUGH) HICKMAN AND MARY JANE MEDAUGH (HUNTER). An it is also my will that my beloved wife Susannah Medaugh whom I hereby appoint sole executrice of this my last will and testament. In witness where of I have here unto set my hand and seal this eight day of August in the year of our Lord one thousand eight hundred and thirty-three, sin sealed published declared by the above names James Medaugh to be his last will and testament in the presence of us who have here unto subscribed our names as witnesses in the presence of the testator. attest James L. Hyde, and proven to be the last will and testament of the said James Middaugh, deceased, by the oaths of James>Hyde and Josiah Morton, Jr. subscribing witnesses therto, James>according to law, and ordered to be recorded - and there upon the said will and this certificate have been duly recorded in my said office.
