JOHN MILLER personally appeared before the Judge of the Scott Circuit Court [illegible] of said County and State of Kentucky aged 67 years next June and being first duly sworn according to Law doth on his oath make the following declaration in order to obtain the benefit of the act of Congress 7th June 1832. The sd JOHN MILLER states that during the revolution he was a resident citizen of Bedford County and State of Pennsylvania that in the month of march or April 1778 he enrolled himself as a volunteer and served his Country Six months in defence [sic] of the frontier against the Shawney [sic] and other Indians & British Troops who invested our Country and made great depredations upon the lives & property of the Citizens, the corpse [sic] was commanded by Col JOHN PIPER I was a Soldier in the Company of JOHN LIVINGSTON & I recollect that a man by name LOT FRENCH was our Seargant [sic] No battles except small parties would meet & fight occasionally with small parties of the enemy & having served the term of Six months and having received pay for the 6 months he returned home ~~ Pg 2 He states that he served a 2nd tour of Six months in the following year viz. 1779. He enrolled himself as volunteer in March 1779 or April as before for the same service and served faithfully the 6 months. He was commanded by the same Officers Col. JOHN PIPER & by Capt JOHN LIVINGSTON The service was arduous & exposed the men to hardship & fatigue & peril etc [illegible] his pay for the second six months. In the next year about the same time of year as before mentioned, in 1780.he enlisted or enrolled himself for six months more under the same Col. JOHN PIPER which he faithfully performed. His capt was by name ABRAHAM COUVAULT the service was faithfully performed for this 3rd six months hardship great I think on this tour it was that part of our company was taken to serve under a U.S. Officer Capt BOYED (?) who had an engagement with the British and Indians and was defeated In the month of March or April 1781 when the enemy was approaching he entered the 4th time for 6 months under the same two last mentioned officers and same kind of service making in all two years, it was our particular service to defend the frontier from the depridation [sic] of the enemy whose lives and property was at all times in the Summer Season in eminent [sic] danger from them. Col PIPER commanded the force all the time He was many years a member of Congress Pg 3 Since the formation of our present Government etc. He is now dead. that the said MILLER served his Country considerably in the year 1782 but not in a regular way (as the Indians continued to be yet troublesome.) and therefour [sic] not necessary to be mentioned Also served irregularly previously to 1778 while very young but this is not necessary to detail He does not know that any of the Officers or Soldiers are living who served with him That he moved to Kentucky in 1790 and defended his Country against the Indians till [sic] the year 1794, that he now lives in Scott County Kentucky & was in ST CLAIR’S DEFEAT in 1791 The reason our service commenced in the Spring of each year is that about this time the Indians commenced there [sic] mischief in the winter they were not so dangerous and the people were left more to defend each other without military force and he further states that he hereby relinquishes any claim whatever to a pension or an annuity except the present and he declares that his name is not on the Pension Roll of any agency in any state JOHN MILLER Pg 4 Scott County State of Kentucky Sct KATHARINE OSBURN this day came before me a justice of the Peace for sd County & made Oath that she is sister to COL JOHN MILLER that she is two years older than her Brother that she lived at her Fathers house in Bedford County Penn during the Revolution that she has this day heard read the declaration of her Brother JOHN MILLER detailing four tours of duty Six months each time making two years in all defending the Frontiers of Penn from the Indians and British in those days & she says that of her own knowledge She knows the statement of JOHN MILLER to be true She knows that he served under Col JOHN PIPER at least 4 tours and 6 months each tour. August 28th 1832 JOB STEVENSON [illegible] I do certify that JOB STEVENSON signed his name above & that he was at the time of signing was a justice of the Peace for Scott County 3rd Sept 1832 RH M JOHNSON Pg 5 We JOHN T JOHNSON a Minister of the Gospel [illegible] in the County of Scott State of Kentucky and RM JOHNSON residing in the same county and state aforesaid do confess that we are well acquainted with COL JOHN MILLER who has subscribed and sworn to the above declaration That we believe him to be the age mentioned in the declaration that he is [illegible] and believed in the neighborhood where he resides to have been a Soldier of the Revolution and that we concur in that opinion J T JOHNSON R M JOHNSON Commonwealth of Kentucky Circuit Court for the County of Scott August 27. 1832 “COLONEL JOHN MILLER of Scott County this day produced in Court a declaration subscribed with his name, in order to obtain to obtain [sic] the benefit of the act of Congress proposed June 7 1832 & to which he made oath in open Court; & also the Affidavit of KATHARINE OSBURN; & also the certificate of JOHN T JOHNSON a minister of the Gospel and of RICHARD M JOHNSON to which they made oath in open Court; and the said Court do hereby declare their opinion after the investigation of the matter, and after putting the interrogatories (?) prescribed by the war department, that the above named applicant was a revolutionary soldier and served as he states: and the Court further certifies that it appears to them that JOHN T JOHNSON who has signed the preceding certificate is a clergyman resident in the County of Scott; and that RICHARD M JOHNSON who has also signed the same is a resident in the County of Scott and is a credible person, & that their statement is entitled to credit, which is ordered to be certified to the department of war.” Scott Circuit Sct - Aug 28 1832 I JAMES H HUMPHREYS Clerk of the Scott Circuit Court of Scott County, do hereby certify that the foregoing contains the original proceedings of the said Court in the matter of the application of JOHN MILLER for a pension. In Testimony whereof, I have hereunto set my hand & seal of office this 28th day of August 1832 J.H. HUMPHREYS c.s.c.c.
