Miller of the City of Cloverport, County of Breckinridge, State of Kentucky, being of sound mind and memory, and knowing it is appointed to all once to die, do make and ordain this as my last will and testament. First I devise and bequeath unto my beloved daughter, Susan Enola Rafferty, all my estate, Real, Personal and Mixed wherever found or situated, in fee simple absolute - that she, the said Susan Enola Rafferty is to control said porperty independently of any husband; especially, and in no event is B. T. Rafferty, the father of her two present children to assume the management and control of any part of said property. Second While trusting to the good sense and management of my said daughter Susan Enola Rafferty, yet I recommend that by the will she devise and bequeath her property and its accumulations to her sons Henry Hovius Rafferty and Douglas M Rafferty share and share alike; and is either should die before her death, then the survivor shall take the whole. And if in the course of nature she should survive both of said children and they should die without issue, then it is my desire and wish that she devise and bequeath her said property and its accumulation to the heirs of my brother, James H. Hovius of Half Moon Bay, San Mateo county, California. Third, It is my desire that all of my Just debts and funeral expenses shall be paid out of any money on hand or from the sale of personalty if necessary. Fourth I appoint my daughter Susan Enola Rafferty as Executrix of my last will and testament without bond and she may take formal possession of all of said property without the intervention of a Court, as it is my desire that the general management of my estate shall be carried out by her without drawback or hindrance from any outside source, though she may, if she thinks necessary, consult with some good business man as to details. In testimony whereof I have hereunto subscribed my name and sealed this instrument and published and declared the same as and for my last will at Cloverport, Kentucky on the 19th day of June 1906.
