From: KyArchives [Archives@genrecords.org] Sent: Saturday, October 30, 2004 10:14 PM To: Ky-Footsteps Subject: Minor-to-McGinnis.1827.Mercer.DEED Mary McGinnis - Et al McGinnis January 26 1827 Mercer County KyArchives Deed Written: January 26 1827 Recorded: July 2 1827 Deed Book 14, page 359 This Indenture made this 26th day of January 1827 between Henry Minor & Lydia his wife, of the State of Missourie, William McGinnis, Hezekiah McGinnis, Samuel McGinnis, John Walter & Peggy his wife late Peggy McGinnis, John Broyles & Elizabeth his wife late Elizabeth McGinnis, Thomas McGinnis, Dorsey McGinnis, Washington McGinnis, Nancy McGinnis, Jefferson McGinnis & Lucinda McGinnis of the County of Mercer & State of Kentucky Heirs & representatives of John McGinnis Dec'd of the one part and Mary McGinnis Widow of said John of the County and State last aforesaid of the Other part, Witnesseth, That whereas the said John McGinnis did previous to his Death make & publish his last Will & Testament which has Since his death been proven & made of record in the Court of said County and carried into execution & effect by the executor therein named And whereas it appears from said Will and Other Circumstances known to us the said Heirs that our ancester the said John was Overseen[?] or mistaken in the language of his Will in relation to the provisions therein made for his widow the said Mary particularly as respected the land & plantation whereon he died, which was to be sold when his youngest child should arrive at full age consequently at that period which will shortly arrive the said Mary would be deprived of all means of support there being but little other provisions made for her in the said last Will & Testament Now for the above recited considerations as well as for the natural love & affection we have for our Mother we the above named Heirs & representatives of John McGinnis Dec'd do hereby sell & convey unto the said Mary McGinnis for and during her natural life all the tract of land together with its appurtinances whereon the said John McGinnis died & whereon the said Mary now lives to be by her enjoyed with all things thereunto appertaining free from all charges for rents or Otherwise for & during the said Term of her natural life and whereas Samuel McGinnis one of the foregoing parties did on the 15th day of December last purchase from the Heirs of John Henderson dec'd a tract of land lying in the Knobbs and adjoining the aforesaid tract whereon the said Mary McGinnis now lives the said Knobb tract containing forty three and three fourths acres and we the said Heirs & representatives believing that by attaching the said Knobb tract to the former One, it the said old tract will be rendered much more Valuable we therefore the said Heirs & representatives by these presents do permit William McGinnis the executor of the said John to pay the purchase money which the said Samuel contracted to pay for the said tract of land in the Knobbs purchased as afsd. out of the money of the said Estate now in his hands or which may hereafter come into his hands the said Samuel hereunto ["against" crossed out] agreeing that the title when made by Hendersons Heirs shall[?] be made to the aforesaid Heirs & representatives of John McGinnis Dec'd Jointly instead of being made to him the said Samuel provided however that if any of the afsd. Heirs should refuse to sign this Indenture or to contribute to the said purchase then in that case the conveyance is to be made to them that does contribute & in proportion to their contribution which said tract of land purchased as aforesaid from Hendersons Heirs is hereby conveyed to the said Mary McGinnis for & during her natural life, in like manner with the former mentioned tract whereon she the said Mary now lives. In Testimony whereof the said Henry Minor & Lydia his wife, William McGinnis Hezekiah McGinnis Samuel McGinnis John Walters & Peggy his wife John Broyles & Elizabeth his wife, Thomas McGinnis Dorsey McGinnis, Washington McGinnis Nancy McGinnis Jefferson McGinnis & Lucinda McGinnis have hereunto set their hands and affixed their seals this the day & date first ["within" crossed out] written. Irvine a Subscribing Witness thereto and on the same day the same was proven to be the act & deed of John Walter, Margaret Walter, Thomas McGinnis and Dorsey McGinnis a party thereto by the Oaths of Andrew McGohon and Mark McGohon two Subscribing Witnesses thereto and on the 2d day of July 1827 the same was fully proven as to the above named William, Hezekiah, Samuel, Washington, Jefferson, Nancy & Lucinda McGinnis a party thereto by the Oath of James Caldwell another subscribing Witness thereto whereupon I have made the same of record.
