Moore Heirs Exd Apr to 1/16 of 44.0.32 Coopers Run 20 George Moore This Indenture made this twentieth day of April in the year of our Lord One thousand eight hundred and fifty seven, Between George Moore Peter Moore Thomas L Moore Robert H Moore and Mary Barton late Moore by James Paton of the County of Bourbon and state of Kentucky, a Commissioner of the first part, and George Moore a party of the second part WITNESSETH: That whereas in a suit in Chancery depending in the Bourbon Circuit Court Wherein Robert H Moore is Plaintiff and William S Moores Heirs defendants it was at the September Term 1853 of said Court amongst other things decreed and ordered, that William Moore was in his lifetime was indebted to the plaintiff in the sum of two hundred dollars to secure which he exectued to the plaintiff on the 9th Oct 1846 the mortgage in the pleadings mentioned and that the same is yet due and unpaid. It is ordered and decreed that the said Mortgage be foreclosed and that the undivided interest of the Defendants in this cause as Heirs at law of said William S Moore deceased in and to the Land described in the mortgage which is one sixteenth part of forty five acres described by metes and bounds in said Mortgage be sold on the premises at Public Auction to the highest bidder on a credit of six and twelve months, the purchaser to give bond with approved security payable to the plaintiff. That Thomas A Taylor be appointed a Commissioner to Carry this Decree into effect, and at the Oct Term 1856 the said court reported that he proceeded on the day of _ to expose to public sale on the premises the undivided interest of the Defendants as Heirs at law of Wm S Moore in & to the Land described in the Mortgage referred to in said decree which is one sixteenth part of forty four acres and thirty tow poles having advertised the same according to the provisions of said Decree and George Moore became the purchaser thereof at fifty dollars per acre and accordingly executed his notes for _ to the plaintiff with good security due in Six and twelve months, which Report was approved of and Confirmed and it was ordered that James Paton be appointed a Commissioner to execute a Deed of conveyance to George Moore the purchaser of the land sold under the decree herein. Now the said James Paton as Commissioner for the party of the first part, in pursuance of said decree and of the statutes in such cases made and provided and of the payment of the purchase money aforesaid doth hereby grant bargain and sell, release and convey unto the said party of the second part, all the right title interest and estate of the said Geo Moore Peter Moore Thomas L Moore Robert H Moore & Mary Barton late Moore as Heirs at law of William S Moore decd being one sixteenth part in and to all that tract of land situate in Bourbon County on the waters of Coopers Run containing forty four acres and thirty two poles and bounded as follows: Beginning at A. two sugar trees, thence So 13'W 9" 7 poles to B. two sugar trees D. a stake thence W 70 poles to C. a stake, thence N 2degrees W 94.7 Poles to the Beginning. being lot N: 10 in the division of Peter Moores decd estate as recorded in the Fayette County Clerks office in Will Book D Page 465. the said interest being derived as an Heir at law of Martha P Moore decd Together with all the premises rights and privileges thereunto belonging or in any wise appertaining. To have and to hold the land premises and appurtenances aforesaid unto the said party of the second part his Heirs & assigns forever. and the said party of the first part doth covenant and bind themselves their Heirs Executors and administrators to warrant and forever defend the land premises and appurtenances aforesaid unto the said party of the second part his Heirs and assigns against the claim or claims of all and every person or persons whatsoever. In testimony whereof the said party of the first party by their said Commissioner have here unto set his hand and seal the day and year first above written. James Paton Comr Bourbon Circuit Court Sct: April Term 1857 The within Deed of conveyance was exhibited into Court by James Paton the Commissioner therein names was examined by the court approved of acknowledged by said Commissioner & ordered to be certified for record Att James Paton CBCC State of Kentucky County of Bourbon} Sct: I R J Brown clerk of the county Court of said County do certify that on this day the foregoing Deed from William S Moores Heirs to George Moore was produced to me for record, and is with the certificates endorsed thereon duly admitted to record in my office.
