Ky Will Book B Written: March 7, 1842 Recorded: April 4, 1842 Spencer Co. KY Will Book B p. 390 In the name of God Amen I ZEPHENIAH B. OFFUTT being very feeble but of sound mind do make this my last will and testament. First I bequeath to my beloved wife all my monied Estate and all the negroes I received with her and their increase during her lifetime and to dispose of them as she may think proper. Also my wearing apparel. I will and bequeath five hundred Dollars to the Catholic Church. I will and bequeath to the Baptist Church, Presbyterian and Methodist Church subject to usury if plead by the persons the Debts are coming from one Hundred Dollars each. I leave my beloved wife as my Executor with one or two other whom she may select the Ballance of my slaves to be subject to my wife and if she cannote manage them she may sell them. Witnessed by M. B. SHELBURNE, H. S. MINOR, GEO. LE PAGE and B. MURPHY At a County Court held for Spencer County on Monday the 7 March 1842 this writing witnessed by M. B. SHELBURN, H. L. MINOR, GEORGE LePAGE and WILLIAM B. MURPHY purporting the nuncupative will of ZEPHANIAH B. OFFUTT Deceased was Produced in Court whereupon on the motion of MARY OFFUTT it is ordered taht a summons issue against said MARY OFFUTT the widow of ZEPHENIAH B. OFFUTT Deceased and ELIZABETH OFFUTT one of the next of kin of said ZEPHENIAH B. OFFUTT Deceased to appear here at the next Court to contest the said will if they think proper and satisfactory proof being made to the Court that the Heirs of REZIN OFFUTT Dec’d whos names are unknown and the heirs of JOHN JONES and CHAISTE JONES Deceased formerly CHAISTE OFFUTT whos names are unknown and LUCY HILTON formerly LUCY OFFUTT the balance of the next of Kin of said ZEPHANIAH B. OFFUTT Deceased are not inhabitants of this Commonwealth and they having failed to enter their appearances herein. On the motion of said MARY OFFUTT, Widow of ZEPHENIAH B. OFFUTT Dec’d a rule is granted her against the said unknown heirs of JOHN JONES and CHAISTE JONES Dec’d formerly CHAISTE OFFUTT and LUCY HILDTON formerly LUCY OFFUTT causing them to appear here on or before the first day of Next Court to contest the said Will if they think proper and further porceedings herein are continued until next Court.
