From: KyArchives Sent: Saturday, June 29, 2013 9:19 AM To: Ky-Footsteps Subject: Pettypool.Stephen.1841.Breckinridge.WILL Stephen Pettypool May 17, 1841 Breckinridge County KyArchives Will Source: Breckinridge County Will Book, 1 Written: May 17, 1841 Recorded: June 18, 1841 LAST WILL AND TESTAMENT OF STEPHEN PETTYPOOL I, STEPHEN PETTYPOOL, of Breckinridge County and the State of Kentucky knowing that it is devised that all men must die do make this my last will and testament in manner following to wit: 1st - I give to my beloved wife MARGARET POOL my two negro men, Bob and Stephen, and my two negro women, Rachel and Francy, and my negro girl America and all my personal property during her natural life and after the death the slaves with their increase and whatever of the personal property may be remaining I wish to be equally divided amongst my heirs but with this provision: It is my wish that after the death of my wife that the negro woman Rachel shall have her personal liberty and if she is unable to maintain herself, I wish she be maintained out of my estate, but should she, the said Rachel, have any children after the death of my wife, such increase is not to be free but is to be slaves as their mother was liberated. This clause in not intended to emancipate Rachel but to exonerate her from serving anyone. 2nd - I give and bequeath to my daughter, PATSY WILKERSON, and her heirs forever one negro girl named Jennie and all her children. 3rd - I give and bequeath to my daughter, EDNESS WILKERSON, and her heirs forever one negro girl names Hildy and her children. 4th - I give to my grandson, LATCHLIN POOL, son of JOHN POOL (deceased) one negro girl named Mopsy, and one hundred dollars out of my estate and no more which one hundred dollars is to be due him at the death of my wife and should my said grandson LATCHLIN die without children, the negro girl Mopsy and the one hundred dollars herein devised to him is to return back to my estate and be divided among my children. 5th - I give and bequeath to my daughter, PEGGY HAYDEN, and her heirs forever one mulatto girl named Martha. 6th - I give and bequeath to my son, SANFORD P POOL, and his heirs forever one negro boy named Tom and all the tract of land he now lives on save for the part I sold to ELIJAH BOARD. 7th - I give and bequeath to my son WILLIAM P POOL, one negro boy named Henry and his heirs forever as I have given my sons SANFORD and WILLIAM more of my estate than their equal parts they are to pay my grandson LATCHLIN POOL the one hundred dollars devised to him. 8th - I give and bequeath to my daughter, SALLY P POOL, one negro girl named Caroline to her and her heirs forever and whereas I have some small negroes not mentioned in this will which I intend to distribute among my children before my death but should I not distribute them before I die, I wish them equally divided among my children now living and further when they or any those devised to my wife are to be divided after my death. I wish the division to be made in the following manner: I do not wish them sold to speculators or strangers. I wish them sold to the highest bidder amongst my children on a credit of 12 months, and the money divided. I appoint my sons SANDFORD P POOL and WILLIAM P POOL executors of this my last will and testament revoking all former wills, as witnessed my hand and seal this 22nd day of July 1837.
