WILL: Prewitt, Beverly, 1851 - Spencer Co In the name of God Amen, I Beverly Prewitt of the County of Spencer and State of Kentucky knowning (sic) the uncertainity (sic) of life and the certainty of death and being now of my usual health and wishing to dispose of the Estate wherewith God has been pleased to bless me I constitiute and ordain this my last will and Testament. Item 1st" I will and desire all my just debts and funeral expenses be first paid out of my Estate Item 2nd" I give and bequeath unto my neice Fanny Rowland the daughter of my Eldest Sister Fanny Elliott one hundred and ten dollars Item 3rd" I give and bequeath unto my neice Nancy Melvin daughter of Stephen Waller one hundred and ten dollars Item 4th" I give and bequeath unto my Great Grandson and Name Sake Beverly Prewitt Grigsby Son of William R and Martha Ann Grigsby a boy Slave by the name Chesterfield and also a little Girl Slave by the name of Adaline the child of Angeline. As to the rest and residue of my estate real personal and mixed whether in land Slaves personalty cash of cash notes. I will and bequeath the same unto my Two Daughters Susan Newman and Tabitha West. It has been my desire in my various advancements unto my said beloved daughters to preserve equal justice between them but I have had occassion to advance unto my daughter Susan Three Thousand dollars for a tract of land of which she has the title and has had the possession and enjoyment for several years, and the land I gave my daughter Tabitha has not yet come to her possession, there is something due her the said Tabitha on that score, And I have given Susan Cannon Woman Nancy of the value of $150 and unto John E. Newman One Hundred dollars and to William Newman Sixty Five Dollars. It is but just that my daughter Susan should account for their sums advanced to her side of the house. These sums and the sums I estimate for the use of her land I fix at Seven Hundred Dollars. It is therefore my will and desire that in the final division of my Estate between my daughters as aforesaid that the said Seven Hundred Dollars be made up to Tabitha to make them equal and the residue to be divided share and share alike between my two daughters. I revoke all former wills made by me I constitute and appoint Samuel Ruble and William R. Grigsby my Executors. Cox David Black At a County Court held for Spencer County on Monday the 5th day of May 1851, This writing purporting to be the last will and Testament of Beverly Prewitt Dec., was produced in Court and proven according to law by the oaths of Joseph B. Cox and David Black Witnesses thereto and ordered to be recorded and time is given the Executors named in the said Will until the next Court to qualify and take out probat. Grigsby and Samuel Ruble Executors named in the last will and testament of Beverly Prewitt Decd, who made oath thereto and together with R.B. Grigsby N G Thomas Anderson M Rice and Nathan Beauchamp their Securities entered into and acknowledged A bond in the penalty of $25,000 Conditioned as the law directs Certificate is granted them for obtaining a Probate of the said will in due form Attest Josph B.
