Abram Pritchett and Ann his wife by James Caldwell their Attorney in fact James Caldwell and Phebe his wife for and in Consideration of the Sum of One thousand two hundred and fifty five Dollars 75 cents to them in hand paid the receipt whereof is hereby acknowledged have granted bargained and Sold and by these Presents doth grant bargain and Sell unto the Said Jesse McGinnis and his Heirs forever One Certain tract or Parcel of land Situate lying and being in the County and State last afs'd on Quirks run and bounded as follows, Beginning at a stone Corner to Thomas Colter in a line of James Hendersons Heirs thence with Coulters line S88W 144 poles to his Corner a Sugar tree and Elm in Robert Walkers line, thence N13 poles to a lynn[?] and white ash Walkers corner thence with his line S86W 40 [or 46] poles to two beeches corner to James R. Armstrong thence with his line N1W 123 poles to his corner a white Ash in Jeremiah Laws's line thence with his line and William Mcginnis's line N88-1/2E 152 poles to a Stone and hoopwood Corner to John Richardsons Purchase on the bank of Quirks run thence up the run with its meanders on the East Side thereof S44W 14 poles S76-1/2w 7- 1/2 poles S70W 8-1/2 poles S20W 2-1/2[?] poles S73-1/2E 7-1/2 poles S3-1/2E 7- 1/2[?] poles S49E 8 poles S13W 15 poles to opposite a marked elm and beech on the bank Corner to sd. Richardson thence S2-1/2E 80 poles to the Beginning containing One hundred and thirty seven acres and three fourths of an acre with its appurtenances to have and to hold the tract of land hereby conveyed with all its appurtenances to the only proper use and bef [crossed out] behoof of him the said Jesse McGinnis and his Heirs foever. And the said Abram Pritchett and Ann his wife by James Caldwell their Attorney in fact James Caldwell and Phebe his wife for themselves their Heirs Executors and Administrators the afs'd tract of land and appurtenances unto the said Jesse McGinnis his Heirs and assigns against the claim or claims of all and every Person or Persons whatsoever doth and will forever warrant and defend by these Presents. In testimony whereof the said Abram Pritchett & Ann his wfie by James Caldwell their Attorney in fact James Caldwell and Phebe his wife have hereunto set their hands and seals this day and date first within written. Mitchell and Samuel Ewing Justices of the Peace for said County do certify that Phebe Caldwell wife of James Caldwell and a party to the foregoing deed of bargain and sale personally appeared before us and being by us examined seperate and apart from her husband with her own free will & con???? relinquished her right of Dower and also her right of inheritance in and to the land conveyed by the foregoing deed and desired us to certify the said acknowledgement to the Clerk of the Mercer County Court in Order that the Said deed may be recorded.
