From: KyArchives [Archives@genrecords.org] Sent: Wednesday, January 18, 2006 11:58 AM To: Ky-Footsteps Subject: Shelton.Henry.1827.Hardin.WILL Henry Shelton August 22, 1827 Hardin County KyArchives Will Source: Will Book 4, Pages 152-154 Written: August 22, 1827 In the name of God Amen I Henry SHELTON of the County of Hardin and State of Kentucky being in a low state of Bodily health but sound in mind and memory, but being very old and infirm and not knowing what time I shall be called from this life and wishing to dispose of my worldly affairs and property do make this my last will and testament As follows, first I recommend my Soul to God from whence it came, and my body to the earth to be buried in a decent and Christian like manner. Secondly I desire that all my just debts and funeral charges be first paid by my Executers hearin after named, thirdly I give and desire to my loving wife Mary SHELTON two negroes one named Limp about 44 years of age and one named Walt about 17 yars of age I also give her my home plantation Also a new piece of land which I have lately purchased of John L HELM lying westwardly from my old farm And all the improvments of both old and new farms with all the farming utensils & also my household and kitchen furniture and also all my stock of horses, cattle, hogs, sheep & ____ ____ ____ waggons and gears during her life or widowhood and after her death or marriage to be disposed of as herein after named Forthly it is my will and desire that my negroes Jeff and Sarah shall be hired out yearly and _____ ____ by my Executors after my decease until the death or marriage of my wife. Upon this condition if the said two negroes Jeff and Sarah at any time between my decease and the death or marriage of my wife shall want to be sold or either of them shall be sold and the money recieved by my Executors and immediatly(divided) between my children to wit: Sarah HOBBS, John J. SHELTON, Francis McKINNY, Nancy PEARMAN, Thomas SHELTON, Elizabeth STOVALL, Susan HAWKINS, William SHELTON, Henry SHELTON and the heirs and legal representatives of my beloved daughter Mary McMAHAN deceased. That is to say one equal tenth part thereof to the heirs of my said daughter Mary McMAHAN which is to be held and kept in the hands of my Executor until the said heirs shall become of age to act for themselves and one equal tenth piece thereof to each and everyone of my aforesaid children to wit: Sarah, John, Francis, Nancy, Thomas, Elizabeth, Susan, William & Henry and if any of them should die at any time herafter then the part or share of that child is to go to his or her heirs or legal representatives forever and if the two Negroes shall not choose to be sold, then the hire to be collected in by said Executors annually and paid to my said children in like proportion as before states until the death or marriage of my said wife Fifthly after the death or marriage of my said wife it is my will and desire that my Executors sell or cause to be sold all and every article of my property personal and real belonging to my Estate and the money arising from such sale to be divided among my children in like proportions and shares and in the same manner as herein named. Sixthly my son Thomas having recieved from me fifty dollars more than any of the rest of my children he is in the division of my Estate as aforesaid to be charged with that sum Seventhly After the death or marriage of my said wife it is my will and desire that my son Henry SHELTON shall have my home plantation on which I now live as his own property with all its improvements But is bound to manage for & take care of his Mother as long as she lives & for which the said Henry in the division of my Estate is so charged with three hundred dollars and if said three hundred dollars should be more than falls to the _____ Equal tenth part he is to pay the rest of the heirs their just proportion Eightly, my daughter Sarah HOBBS having recieved from me fifteen dollars more that any of the rest of children she is charged with that sum Ninthly and lastly I appoint my two sons John J SHELTON and William SHELTON my executors of this my last will and testament or in case of both not being qualified then the one that does to act in eery respect as if both had qualified hereby revoking all former wills by me made & declared this only to be my las will and testament In testimony whereof I have hereunto set my hand and affixed my seal this 22nd day of August 1827 signed sealed published and Henry SHELTON delivered by the Testator to be his last will and testament in persence of us who have subscribed or names as witnesses Hezekiah STOVALL Thomas McKENNEY Submitted by: Donna Miller dkmiller@carrollsweb.com This file has been created by a form at http://www.genrecords.org/kyfiles/
