Deed Bk H, p 408-410 JOYCE SIMMONS; SUMMERS This Indenture made this 23rd day of March Eighteen hundred and thirty seven between Thomas JOYCE of Shepherdsville Bullitt County Kentucky of the one part and Richard P. SIMMONS of the same place of the other part Witnesseth that whereas said Thomas JOYCE Stands justly indebted to the said Richard P. SIMMONS in the sum of fourteen hundred and forty Dollars by note bearing even date therewith payable two years after date due being desirous to secure the same to said Thomas Joyce agrees to convey certain property to said Richard P. SIMMONS for that purpose. Now in consideration of the premises and the further consideration of the sum of one Dollar by said SIMMONS to said JOYCE in hand paid he said JOYCE has sold and by these presents does sell and convey unto him the said Richard P. SIMMONS and his heirs forever the following property in Shepherdsville Bullitt County viz. One Lot of ground No 21 also Lot No 22 in said town the same on which said JOYCE has erected his Steam mill also sells hereby to said SIMMONS the Steam mill engine boiler mill Stones mill irons and all and singular the whole of the apparatus and appurtenances belonging to the said steam mill as it now stands for use; he also has heretofore conveyed to said Richard P. SIMMONS the lot of ground upon in said town upon which the tavern house of said JOYCE is now Situate reference to said mortgage of record in the Bullitt County Court dated 27th of January 1835 will now particularly Shew the property. The said JOYCE also hereby further sells and conveys to said Richard P. SIMMONS all his equity of redemption in said property and all interest he has to said property for the purposes herein Specified. To Have and To Hold all and Singular the said Several Lots of ground aforesaid and appurtenances thereto belonging and the said Steam mill ____ and apparatus &c as aforesaid composing said mill complete to him said Richard P. SIMMONS and to his heirs forever and said JOYCE covenants to and with said Richard P. SIMMONS and his heirs that he will and his heirs shall warrant and forever defend said property unto same SIMMONS and to his heirs forever against the claim or claims of all and every person whatever. Provided always and this Conveyance is made upon ____ condition that if he said Thomas JOYCE does well and truly pay unto the said Richard P. SIMMONS or his assigns the said sum of fourteen hundred and forty dollars within the two years as and where said ____ is herein, Specified becomes due aforesaid then this Conveyance Shall become null and void and of no effect and the property hereby conveyed to be reconveyed to said JOYCE otherwise to remain in full force and virtue. In Witness whereof said Thomas JOYCE has hereunto set his hand and Seal the day and date first herein written; and it is expressly understood and agreed between all parties that this instrument is intended to operate as a mortgage upon the mill and Lots and Steam engine YE as herein expressed and as an additional mortgage upon the house and lot that is the tavern property to __ mortgage already existing and if this Debt should be paid by JOYCE at any time, and the first mortgage on the tavern house remains unsatisfied, that mortgage is not to be effected by the payment of the sum hereby secured until the whole amount for which the tavern house was heretofore mortgaged is paid and satisfied, and when both Sums are paid and Satisfied ___ Tavern house and the mill lot and property are to revert as fully and effectually in the said JOYCE as tho these presents had never been.
