To: KYF Subject: Smith.et_al.1824.Garrard.DEED2 Et al Smith - Samuel (Estate of) Black April 22 1824 Garrard County KyArchives Deed Written: April 22 1824 Recorded: April 22 1824 Book J, page 48 This Indenture made this 22d day of April 1824 Between Augustine Smith and Robert Brank Executors of the last will and testament of Samuel Black dec'd, of the one part and Betsy Alexander, Polly Jenkins, John Smith and Augustine Smith heirs and representatives of James Smith dec'd of the other part. Witnesseth that whereas by the will of the Said Samuel Black dec'd he directed the tract of land herein after mentioned to be sold on the death or marriage of his widow, and whereas she afterwards did marry and thereupon the afs'd parties exposed Said Tract of land to sale at auction agreeable to said devise on the 4th day of February 1819, and thereupon the afs'd James Smith, now deceased, became the purchaser for the consideration of thirty five hundred and sixty three Dollars and whereas said Smith afterward, to wit, on the 15th day of Dec'r 1823 departed this life without having received a title to the said land and leaving the afs'd parties of the second part his only heirs and legal representatives. Therefore in consideration of the premises the said parties of the first part do hereby convey unto the said parties of the second part the said tract of land containing two hundred and sixty nine acres lying in Garrard County on the head waters of Paint lick and bounded as follows, to wit. Beginning at the South East corner of Humphrey Best's Settlement at a white oak thence S30W 26 poles to a Spanish oak on the bank of a branch thence S30W 114 poles to two white oaks standing in the old line of Humphrey Best thence N59W 110 poles to a black oak thence N7E 20 poles to a white oak on the South side of the branch thence N28W 32 poles down said branch to the first considerable bend in said branch thence N48W 56 poles down said branch according to the meanders of said branch to a hickory standing on the East side of the branch in the old line between Samuel Black and Robert Adams thence with said line N85W to a hickory or now a stone standing in the North West corner of Robert Adams old meadow thence due North 31 poles to a stone thence N73W 62 poles to a hickory and dogwood pointers in the old settlement line of Humphrey Best thence N30E 103 poles to a hickory thence N85E 89 poles to a honey locust tree thence S82E 76 poles to a mulberry and sycamore and Elm trees on a branch thence up said branch as it meanders to where the preemption line crosses said branch thence with said preemtion [sic] line S30W to the Beginning. To have and to hold the said tract of land with all its appurtenances to themselves the said parties of the second part and their heirs be the same more or less free from the claims of all persons whatsoever absolutely and forever.
