From: KyArchives [archives@genrecords.org] Sent: Monday, March 19, 2007 11:43 AM To: Ky-Footsteps Subject: Wheeler.&.Stansberry.Robinson-&.Breckenridge.Pope.1831.Bullitt.DEED Robinson Wheeler & Stansberry - Pope & Breckenridge October 6, 1831 Bullitt County KyArchives Deed Floyds Fork Written: October 6, 1831 Recorded: April 3, 1832 Bullitt Co., Circuit Court Deed Bk A, pp 182-185 POPE; BRECKENRIDGE; ROBINSON; WHEELER; STANSBERRY; SUMMERS; LARUE; Whereas heretofor viz: on the 6th day of October 1831 in a Suit in Chancery pending in the Bullitt Circuit Court of William POPE Jr Worden POPE and Robert BRECKENRIDGE against James ROBINSON and Hannah his wife Benjamin WHEELER and Eleanor his wife and Joshua STANSBERRY &c by a decree of said Court said Complainants recovered against said Defendants certain Lands in the decree mentioned which may be Seen by reference to said decree part whereof is in these words, "That the said James ROBINSON and Hannah his wife Benjamin WHEELER and Eleanor his wife and Joshua STANSBERRY do on or before the said first day of November next release and convey all their right title Interest and claim of in and to all that part of the said 688 acres 112 acres 600 acres and 400 acres which lies on the lower side of Floyds fork and within the bounds of the said 21000 acres unto the Said William POPE Robert BRECKENRIDGE and Worden POPE" and upon failure of said parties to make said deeds on or before the said first day of November next that then and in that case that Noah C. SUMMERS Esq be and he is hereby appointed to Commission to make Said deed for them after said day and said failure but not before that day And Said defendants ROBINSON and wife WHEELER & wife and Joshua STANSBERRY having failed to comply with the requisitions of Said decree and said deed not having been made and executed as said Complainants have informed me, Now Therefore This Indenture Witnesseth That the said Noah C. SUMMERS Commissioner as aforesaid for and on behalf of said James ROBINSON and Hannah his wife Benjamin WHEELER and Eleanor his wife and Joshua STANSBERRY of one part and William POPE Jr Worden POPE and Robert BRECKENRIDGE of the other part for and in Consideration of the premises and by virtue of the power in me vested by said decree I Said Noah C. SUMMERS commissioner as aforesaid have and by these presents do grant bargain sell and confirm unto the said POPES and BRECKENRIDGE all the right ti tle Interest claims and demand of them the said James ROBINSON and Hannah his wife Benjamin WHEELER and Eleanor his wife and Joshua STANSBERRY of in and to the Said Lands of Land aforesaid of 688 acres 112 acres 600 acres and 400 acres in Said decree mentioned which lies on the lower side of Floyds fork in Bullitt County and within the boundary of the 21000 acres claim of sd Complainants patented to James LARUE, in said decree also mentioned said several Tracts of Land, here mentioned of 688 acres 112 acres 600 acres and 400 acres are the Same tracts of Land said to be patented to Thomas STANSBERRY and claimed by defendants and recovered by the decrees in the Chancery Cause aforesaid and which Said defendants therein were decreed to convey and Surrender up to Complainants POPE'S and BRECKENRIDGE and which they have as aforesaid failed to do To have and To hold said Several Tracts of Land as aforesaid to Said William POPE Jr Worden POPE and Robert BRECKENRIDGE and their heirs and as signs forever and I the Said Noah C. SUMMERS Commissioner as aforesaid, appointed in and by virtue of the Decree aforesaid do hereby for and on behalf of said James ROBINSON and wife Benjamin WHEELER and wife and Joshua STANSBERRY warrant and defend the Said Tracts of Land aforesaid or Such parts thereof as lie on the lower side of Floyds fork and within the boundary of the lines of the said 21000 acres Survey owned by said POPE'S and BRECKENRIDGE unto them the Said POPES and BRECKENRIDGE and to their heirs forever against the claims of Said ROBINSON and wife WHEELER and wife and Joshua STANSBERRY and against the claims of all others as fully as by Law and by virtue of Said decreed I as Comm as aforesaid can warrant and defend and no further In Testimony whereof I have Set my hand and Seal as Commr for and on behalf of said Grantors and parties of the first part this ninth day of November One thousand Eight hundred and thirty one.
