I William TAYLOR of Nelson County and state of Kentucky being in good health & sound mind and memory do make and Ordain this my last will and Testament. First I direct that all my just Debts be pain after which I dispose of my Estate in the following manner. To wit, I give and bequeath to my wife Rachel TAYLOR the Plains below and Tract of land whereon I now reside during her widowhood but if she should marry again, than it is my Desire that she shall have one third part of said Tract of land including the House and Plantation as long as she shall live and at her Death then that whold of the said Tract of land to be equally divided among my four Sons Isaac TAYLOR, John TAYLOR, Thompson TAYLOR and James TAYLOR. I also give unto my said wife one negro woman RACHEL and her increase to be at her own Disposal but if my wife should die without a will, then in that case I wish the said negro woman sold and the money equally divided among all my Children. I g ive and bequeath to my said wife two Horses, two cows and calves all the Sheep and Hogs, all my Household & kitchen furniture during her life and at her Death to be divided equally between all my Children. K have a number of books, which would not be useful to my said wife which I wish disposed of but such a part as she may want, she is to have and retain for her own, the Balance to be Sold and the proceeds to be equally divided between all my Children. - I Give unto my four Sons Isaac TAYLOR, John TAYLOR, Thompson TAYLOR and James TAYLOR equally a tract of land containing one Thousand acres on Philps fork of Pitmans Creek, patented to me the 5th of May 1786 to them and their heirs forever. I give to my three Sons in Law Moses PIERSON, Isaac WHITAKER and William MARSHALL to be equally three hundred and twenty two acres of lands to them and their heirs forever lying on Sinking Creek. all the rest of my estate not disposed of with what out Standing Debts I have, It is my desire sh all be equally divided between my wife and Children and lastly I appoint my beloved wife Executrix and Joseph LEWIS Executor to this my last will and Testament hereby revoking all former wills and Testaments legacies &c. In witness whereof I have hereunto set my hand and Seal this 23rd day of July in the year of our Lord, One thousand Eight Hundred and Five William TAYLOR [seal] Executed In presents of us James SMILEY William SMILEY At a County Court held for Nelson County on Monday the 14th day of December 1807 This last will and Testament of William TAYLOR deceased is proved by the Oath of James SMILEY one of the Subscribing witnesses thereto and ordered to be Certified and it is Ordered that a Commission be issued and be hereto annexed director or proscribed by law to authorize the taking and Certifying the attestation of William SMILEY of Westmoreland County and State of Pennsylvania the other Subscribing witness thereto. Teste Ben GRAYSON Westmoreland County Sct Commonwealth of Pennsylvania Agreeable to a commission issued out of the County Court of Nelson State of Kentucky to take the deposition of William SMILEY one of the Subscribing witnesses to the last will and Testament of William TAYLOR formerly of the said County of Nelson. Before me John NELSON one of the Justices of the peace in and for said County personally appeared William SMILEY and being duly attested according to law deposeth and saith that the said Testator requested him to Sign the said will and witness which he did and heard the Said Testator to with William TAYLOR acknowledge the annexed will and handwriting to be his act and deed and declare the Same to be his last will and Testament and that he was of deposing mind and memory at that time but does not recollect of seeing him Signing his name or of requiring any other to do it for him and further saith not. Sworn and Subscribed before me the 9th day of May A. D. 1808 Witness my hand and seal. Wm SMILEY [seal] John NELSON Westmoreland County Sct I Thomas HAMILTON Pre_____ of the Court of Common Pleas of Westmoreland County in the Commonwealth of Pennsylvania do hereby Certify that John NELSON esquire who administrated the above written deposition and before whom the Same was in due form of law Sworn to and Subscribed by William SMILEY as is above Set forth was at the time of doing thereof and of administering the same one of the Commonwealth' s Justices of the peace for the Township of Donnigall in said County by lawful authority Commissioned and Sworn. In Testimony whereof I have hereunto set my hand and affixed the Seal of my [Seal] Office this twenty first day of May one thousand Eight Hundred and Eight. Thomas HAMILTON Pro__thy At a County Court held for Nelson County on Monday the 18th day of July 1808 This last will and Testament of William TAYLOR decd being heretofore proved by the Oath of James SMILEY one of the Subscribing witnesses (hereto is again) exhibited in Court with the attestation of William SMILEY the other Subscribing witness thereto and the Certificate of Thomas HAMILTON annexed is ordered to record and on the motion of Joseph LEWIS the Surviving executor therein named having taken the Oath prescribed by law and executed bond with Moses PIERSON his Security in the penalty of $7500. Conditioned according to law. it is ordered that Certificate of Probate of said will be granted the said Executor.
