The land is the tract which Charles C. Whaley owned at his death and on which Moore then resided. Land included a homestead valued at $1,00, which was exempt from sale under executions or attachments for debts. This conveyance in trust for following purposes: Moore was in heavy debt and wanting to pay these debts off as quickly as possible, directed the trustees to sell the property and collect the debts due Moore. After paying, first the expenses of this trust, they were to pay Moore's debts as fast as practicable. Moore had already advertised a sale of his property to take place on his premises on 13 Oct 1871. The trustees could sell it that day or when they thought best. There was a lien for the unpaid purchase money on the land to William H. Berry, or his trustee, and from him to H. J. Baird, as commissioner in the action of Hattie Whaley and others on petition, pending in the court.
