BUCKHOUSE, Charles B. MAY, Abner NORMAN and Mark E. HUSTON or any three of them being first duly sworn before a Justice of the peace to lay off and assess unto Elizabeth TUCKER widow and relict of Thomas TUCKER Decd her Dower in the land, slaves and personal Estate of which her husband died seized and possessed and make report through the court A Copy List Raphl LANCASTER Spencer County Sct This day Charles B. MAY, Abner NORMAN and Mark E. HUSTON personally appeared before the undersigned a justice of the peace in & for the County afrsd and were duly sworn to discharge the duties of Commissioners as required in the within order legally impartially & faithfully and to the best of their abilities. Given under my hand as Justice as afsd this 13th of Sepr 2848. Jas W. BECKHAM JPSC In obedience to an order of the Spencer County Court made at the September County Court 1848 appointing the undersigned as Commissioners to lay off and assign unto Elizabeth TUCKER widow and relict of Thomas TUCKER Decd her Dower in the land & slaves of which her husband died seized & possessed, do report; That we met on the farm on which the said Thomas TUCKEER lived and died lying in Spencer County Kentucky. On the 13th day of September 1949 and having been first duly sworn according to law proceeded to perform the duties assigned us by said order. We first caused to be surveyed the entire tract of land upon which sd Thomas TUCKER lived & died a Plat of which together with the _____ distances ____ and corners of the same are as laid down on this paper here referred to and made part of this report and marked, A which paper Marked A, is as follows towit: Surveyed for the heirs of Thomas TUCKER Dec'd a tract of land on the waters of Elk Creek and bounded as follows Towit: Beginning at a Blue ash Dogwood & cherry thence N 89 W 167 ½ poles to a stone in the land thence north 2 East 56 ¼ poles to a stone thence North 22 ½ west 64 poles, thence North 18 west 67 ¾ poles to a stone come to stone thence North 88 ½ East 187 poles to a stone near a spring thence north 84 East 80 ¼ poles to a Burr oak on the creek thence down the creek south 16 ½ East 38 poles south 16 west 25 poles south 1 East 48 poles south 54 east 39 ½ poles south 18 East28 ½ poles to a small sycamore on the creek thence south 64 west 23 ¼ poles to a stone thence south 55 west 54 poles to a white ash in a branch thence north 86 ½ west 40 poles to two sugar trees thence north 15 East I poles to the beginning containing 288 ½ acres. The entire tract of land contained 288 ½ acres. We then proceeded to assign and lay off to Elizabeth TUCKER widow and relict of the said Thomas TUCKER Decd her Dower in the tract of land as described in the paper ___ as follows: Beginning at a Beech as described in the paper ___ running thence north 89 west 129 poles to a stone in the land thence north 2 E 56 ¼ poles to a stone. Thence north 22 ½ west 64 poles thence north 18 west 67 ¾ poles to a stone come to stand thence north 88 ½ E 68 ½ poles to a stone Corner to _____ & Tucker thence south 16 E 131 ½ poles to a stone on the branch below the house thence north 82 E. 54 poles to a stone on the branch thence south 13 E 63 ½ poles to the Beginning containing 89 acres including the dwelling house. The Dower as laid down on the plat & paper marked A is designated on 0o plat by the letter A. We then proceeded to assign unto the said Elizabeth TUCKER widow and relict of the sd Thomas TUCKER Decd her Dower in the slaves of which her husband died seized and possessed. and _____ thereto we valued the slaves belonging to the Estate of said Thomas TUCKER Decd as follows: AFRICA valued at $700.00 SUSAN and her child named LAURA ANN at 600.00 PHEBE at 250.00 JOHN at 250.00 An old woman names JUDA at nothing 00. Total value at $1800.00 We then proceeded to assign Mrs Elizabeth TUCKER her Dower in the aforesaid slaves and assigned to her AFRICA valued at 4$700.00 as her Dower in said slave > $700.00 From which it will be seen that the slave assigned to the widow as her dower and so done by the consent of all the heirs concerned amounts to one hundred Dollars more in value than she is entitled to, she is therefore to pay to the heirs of Thomas TUCKER Decd the sum of one hundred Dollars that being the amount she owes them on account of her Dower in the Slaves of her Deceased husband. All of which we respectfully report to the Spencer County Court. Given under our hands as come this 15th day of September 1848 Mark E. HUSTON Abner NORMAN Chas B.
