July the 6th day 1808. I Eli ELEY do make this my last Will and Testament. First I resign my soul to God who gave it and my Body to the earth from whence it was taken to be decently buried according to the directions of my Executors. My worldly property I devise in the following manner (viz.) First I require my Executor to pay all my just debts. Secondly, I give to my well beloved wife Prudence half of my land, her choice, and half of the incomes of my stills during her life. I likewise give her two negro boys named Minor and Sam and two negro girls named Annaka and Read during her life. I likewise give her all my stock of horses, cattle, sheep and hogs and all my household furniture except what is otherwise devised in this my last Will and Testament during her life. Thirdly, I give and bequeath to my son Edward ELEY half of my land at my decease and the whole thereof at my wife's decease and one negro boy named Clark (N. B. He is only entitled to the two hundred acres of land I now live on) he is to have half of the income of my stills and at the decease of his mother is to have the whole of the stills and their funiture. Fourthly, I give to my daughter Polly Philips ELEY one negro boy named Jordan and a negro girl named Silvey and a bed and furniture. Fifthly, I give to my daughter Patsy BROWN three negro girls named Hager, Amey, Sarah. Sixthly, I give to my daughter Tabitha ELEY one negro girl named Sharlott and two-eights of land I hold on the ridge adjoining the two hundred acres I now live on on the Easterly one pattented, the others entered and surveyed, likewise a bed and furniture. Sevently, I give to my son Edward ELEY a bed and furniture. Eightly, I give to my wife all the remaining property I die possessed of to be at her disposal during her life and at her death I devise that all the property she dies possessed of, except what is otherwise devised, be divided among my children and my son Eli's children in the following manner. First, my son Lawrence ELEY is charged with fifty dollars and my son Edward ELEY is to pay one hundred dollars, my son-in-law Elisha COLLINS is to discount two hundred dollars and my son-in-law George BROWN is to discount one hundred dollars making in all four hundred and fifty dollars which sum is to be divided into four equal parts and my son Eli's children to have one share, my son-in-law Mark GILLIAM is to have one share, Polly Phillips ELEY one share, and Tabitha is to have one share. Then after those four shares are paid to those above named there is to be an equal division of the remaining undevised property giving to each of my children an equal share including Eli ELEY's children who are to have one share among them. I likewise nominate and appoint my wife Prudence ELEY Executrix and my two sons Lawrence ELEY and Edward ELEY to be Executors of this my last Will and Testament.
