CLARKSON, no age, date or new data. William SABINS . lived 1/4 mile from Hezzy PAYNE. George GLOVER, 38, Monroe. William Martin "of colour", 24 yrs old, Monroe. Lived on Sam GERALD's land. Ed RAY, 63 yrs old, Monroe, farmer. Mrs. Sarah T. PEDEN, 45, Monroe Co. Wife of William, has 2 children. W T PEDEN, 45, Monroe, farmer.H/o Sarah. George DAVIS, 32, Monroe, farmer. Britt HODGES, 38 next Sept, Monroe,farmer. J. H. NEWMAN, 29, Tompkinsville, clerk of the Monroe Co Court. After all this, no deposition of the case was found in the bundle. They were tossed from the court house attic into the bed of a truck below in garbage bags, thus rescued, by permission by Eva and Gladys.So sometimes the "bundles" of each case broke apart and pages are missing. William CRAWFORD, shooting with intent to kill ShermanRASNER. Latter lived. Witnesses: Jas RASNER, Jas WASHAM. Unable to execute - Crawford went to TN. Case 58 - 1891. Indictment of Bill HUTCHISON, stabbing with intent to kill L. D. SPEARS with a knife, Spears lived. Witnesses: L D SPEARS, Isaac THOMPSON, W. JAMISON. Filed but not executed, Hutchison fled to TN. JACKSON, selling mortgage property in Jan 1898 - a yoke of oxen, a horse and hogs on which Mrs. T L EVANS had the mortgage. Delivered to him 10 Nov 1898. Filed 11 June 1898: No 991 - Thom. HELSON/HENSON. Jasper HAYES, foreman. Witnesses: Ed EAGLE, Tom HINSON. Retailing spiritous liquors without a license Jan 1898. Went to IL. No 992 - Same as above, also sold to Henry COUNTY. No. 1327, filed 9 June 1900. Abe CROSS for trespass. Witnesses: Guess ARTERBURN, Henry GOAD, E T THOMAS. He took, but without felonious inention, $10.00 that belonged to James YOUNG. Executed. John COE, liquors sold to A B PAGE & Henry DENHAM. Executed. No 1314, 10 Feb 1900. Turner BARTLEY for disorderly conduct in Tompkinsville. C A AUSTIN foreman; witnesses: Bird SARTIN, Andy BENNETT and L E WILLIAMS. Executed. This ends the series of indictments - next week back into regular court cases. Robert S. GRAVEN vs Lizzie GRAVEN, case330, filed 21 Oct 1899. Divorce - said they were married in 1895; he lives in Monroe Co and she does not. They separated in 1896 - thinks she is now in Sumner Co TN. Deposition of J A GRAVEN was taken 7Feb 190-, said he was 28 yrs old, a liverman (liveryman?), and the parties lived on Big Sulphur Creek in Monroe Co. Also the deposition of L I McMILLIN taken 22 Dec 1899. 19 years of age, farm worker, knew the parties 5-6 years and that Lizzie left about 3 yrs ago in Oct 1896. No results shown. S R GRAVEN vs Mary W DIXON, John T DIXON, J R PARKE, J W WILEY, Alexander WILEY, Sarah J WILEYand Willie A AMYX. Case 500, filed 19 Feb 1892. Re tract of land in Monroe Co - wrong person had been sued in error in a previous case. Mollie PICKEREL vs Linsey PICKEREL, case 151, filed 21 Feb 1891. The couple had married in TN; theylived together until July 1890 ...she was kind etc. etc, but he was cruel and inhuman, had an aversion against her (this is standard legaleeze language). Prays for divorce. There was an amended petition by Mollie to correct inadvertent errors. Added they had 2 hildren - a boy about 5 yrs old now and a girl about 3. His morals so bad, he not fit to raise children. Depositions taken: Thomas WIlson, 17June 1891. 23, farmer, Monroe Co. Long questioning Tennessee POLLAND, 34, farmer, Monroe Co. J F EMMERT, 39, Tompkinsville, Marshall of Tompkinsville. No decision shown. Case E56, filed - date not shown Plaintiff: J O DANIEL, administrator of Sam MARTIN "of colour" and John B. MARTIN "of colour" vs John B MARTIN. Sam MARTIN was owner of a bay horse, a heifer, 2 horse road wagons, a set of harness ... and John B MARTIN took them. Prays for recovery. Depositions taken of: Sherman SPEAR 25 Apr 1902. 34 yrs old, lawyer, reside Tompkinsville. Knows the parties. Papers in the case were burned at his law office on 6 May 1901 in a fire. Submitted what was left. No conclusion in file. Case 375, filed 29 July 1895 Sallie, Claude and Eugene GREEN by their guardian J O DANIEL vs Oscar GREEN, Emma MAXEY, W T BRYANT, S M GREEN, Ada and Fred KIMBERLIN. Plaintiffs all under age 21; DANIEL appt guardian in 1898. Defts - Ada wife of Fred Kimberlin. Reference land in Monroe Co. Names sited as propertylines: E R THOMPSON, GUIN, A B JACKSON EUBANKS, BRYANT, RAMSEY, GREEN, James WOODS, John ROUSE. Praying for a sale of the property. Sold. W G HUGHES, a committee for Charles Thomas DENHAM, a pauper, idiot, and his security was W S MAXEY. Committment to the Commonwealth of KY, 11 Apr 1888. 3 Jan 1888 - DENHAM charged with idiocy. Jury seated: J B CRAWFORD, J A WILLIAMS, H L BAILEY, C A AUSTIN, Wm. COMER, J N HAMMER, John NEAL, Tobias VANCE, O D SPEAR, W S SMITH, J T McMILLIN and W H PAGE. Said that DENHAM was born in Monroe Co; parents live in same county. He has no property to support himself, not of mental capacity to take care of himself. Mind grows worse and is getting harder to control. His mother is unable to labor and is in bad health; father can not labor more than half the time. Found to be an idiot, W G HUGHES appointed a committee (guardian) who will take him into his home and be paid $75.00 a year for expenses. Case: 463 Filed: 29 Aug 1901 Plaintiffs: Julia HUGHES and husband WG; Sallie FLIPPIN and husband J A; Bettie CHISM and husband T K; Basil RICHARDSON, T P EVANS, administrator of J B & Tabitha EVANS; R V EVANS, R B EVANS, J B EVANS & T P EVANS Defendants: Basel and Willie A EVANS, guardian for Bascal EVANS and Mervin HAGAN. J B EVANS Sr died in 1888, a resident of Monroe Co, with a will. Tabitha EVANS (surviving widow of J B), died instestate in 1901. T P EVANS was appointed Adminstrator of Tabitha's estate, and of Jr's estate. J B Sr left daughters and sons - Julia HUGHES who married W G, Sallie FLIPPIN who married J A; Bettie CHISM who married T K, Beddie HAGAN (now deceased) who was married J M HAGAN, Mary B RICHARDSON who married Basil. The sons were T P, R V, R B, J B and Nimrod EVANS. Prior to death of SR, he had a son named William who died prior to his death leaving Bascal as his son, over 14 years and less than 21 years of age. Beddie (Bedie) left a child, Mervin HAGAN, not more than 2 who is in custody of John B PAGE - does not have a guardian. Case deals with the distribution of estates and land. Named are J. HONE's cabin, THOMAS corner, D H & Dessie WOOD, Mill Creek Meeting House area, "where old man George CROW died", John EMBERTON's spring branch, W S MAXEY, Wm B STEEN, BUTLER's tract (now GEE's), E J MAXEY, Jas CRAWFORD, Corporation of Tompkinsville, J B WOODS, "where Wm. MULKEY lives", CHISM, MOORE, John GRINDSTAFF, land in Tompkinsville on Main Street, Mechanic Street, land on Meshack Creek - Sally BRYANT used to live, Boles PITCOCK, Birum HUGHES. There were 11 tracts of land plus land on Meshack Creek. Names above are primarily lines.Copies of the original deeds are given. No disposition of case shown. No. 741, filed 8 Apr 1905. Plaintiffs: James C DANIEL, Administrator of Geo. SHORT Defendants: Elizabeth and Rebecca DYRE, Lucy and Geo. PRUIT(T), Jesse F and Mrs. Sarah SHORT, Carroll and Pha BAILEY, Jesse COE and Rad BAILEY and the Deposit Bank of Monroe Co. KY. Geo. SHORT died intestate in 1905 and left the following heirs: ELizabeth SHORT DYRE who intermarried (married) Willie DYRE, Rebecca SHORT DYRE who md. Steve DYRE; Lena SHORT who md Geo. PRUIT (she now dead and left two children Lucy and Geo who are under age 21); Jesse F SHORT and hs widow Sarah SHORT. Case involved land in Monroe Co - property lines included Jesse F COE, Rad BAILEY, BAILEY, James D SHORT, Levi SPEARS's wife. Another property on the Cumberland River - William SIMS, MARTIN. Necessary to sell the land to pay the debts - was requesting survey, appraisement, widow's dower distribution. What was left over to go in 1/4th to Rebecca DYRE, ELizabeth DYRE, Jesse F SHORT; 1/8 to Lucy PRUITT; 1/8 to Geo PRUITT. The land was surveyed in Jan 24, 1906. Depositions were taken of W T DAVIS 7 Feb 1906 who was 47, farmer, Monroe Co. Also of Rad BAILEY, age 38, railroad tydealer [sic]. Jesse F SHORT non-resdent - lived in Clay Co TN. (Celina). File 62, filed 18 June 1888. W. Kirk RICHARDSON vs J D SHORT, Wm T. PERDUE. Short left a promissory note in 1884. Agreed to pay RICHARDSON at certain times and at certain interest rates. This for a parcel of land - hasn't paid. J E McMURTRY sent not to the Monroe Co Clerk dated 16 June 1888 from Burkesville, KY. Was sending a young man who he believed to be a MAXEY from Monroe Co. Described him as a heavy set fellow of red complexion - he will take care of the matter. No conclusion in files. File 209, filed 21 December 1893. John H QUIGLEY vs Elzina F QUIGLEY. Plaintiff says that they were married July 1875. Plaintiff now resided in Barren Co KY and has lived there for the past 39 years. Wife lives in Monroe Co - has lived there the last two years. They separated in December 1891 when she abandoned him. Prays for a divorce. Richardson & Spear, attorneys. Deposition of Daniel G WILLIAMS, 13 January 1894. 45 years old, reside arren Co, farmer. Said he had lived in sight of the plaintiff about 6 years and about 10 miles of defendants since she left him. THought he was a good husband. Deposition of John W GENTRY, same time. 59 years old, live in Barren Co - lived about 1 1/2 miles from plaintiff and about 10 miles from defendant. When defendant left, she went to live with her father. She had left him once before. He was good to her. Said they had five children - 3 girls and 2 boys. The youngest child is 6 years old - she didn't take the children with her when she left. Deposition of J H NEWMAN, same date. 27yers old, live Tompkinsville,was clerk of the Monroe Co Court. Knew the parties, have the records. No results shown in file. Case 4, filed 10 Dec 1887. James H HARLIN, plaintiff vs Jasper HAYES (administrator of J E DODSON, decd), WIlliam H DOTSON, S R DOTSON, R C DOTSON,Ella B DOTSON and Jasper EMBERTON (guardian for W H, S R, R C and E B DOTSON. Note - name is spelled DOTSON and DODSON. John D DOTSON died in Monroe Co KY in 1800 leaving: Mary DOTSON (widow who died intestate) and the following children and heirs, each under the age of 21: Willie H, S R, R C and Ella B DOTSON. Jasper HAYES qualified as administrator in 1888 - completed this several years ago. Estate of the deceased was insolvent and insufficient to pay all of his debts. He owned land on the East Fork Creek in Monroe Co - property lines included a saddler shop run by E M RUSSELL, G DREEVES, C HAYES. Land was laid off leaving widow and children residing on it. After the widow's death, children moved. Requesting sale of this portion of land. End of file. File 247, filed 2 May 1893. Elizabeth GENTRY vs Robert GENTRY & Tom CREEK Elizabeth states that they were married in 1890, are residents of Monroe Co. Lived together until March 1893 when he deserted her. Cruel, inhuman, curely beat, permanently destroyed her peace and happiness, but she treated him kindly. He had a violet temper. He owns some household and kitchen furniture and other personal property and there is due him from Thomas CREEK something else. She contents that defendant will fraudently sell and dispose of everything to keep her from getting alimonyand maintainance unless he is restrained. Deposition of Henry DISMAN, 1 Feb 1894, Flippin, KY. 51 years old, farmer, know both. Said the parties were married at Isaac EVANS' house in Monroe Co in March 1890. Elizabeth now resides at his house, about 7-8 miles from where their home was. Robert left her in March 1893, the 4th time he had done so. Never left her anything to wear, no wood to make a fire - deponent provided most of her needs. Deposition of Thompson DISMAN - same time and place. 19 years old, Monroe - have known about 9 years. No disposition of case in rescued files. These are abstracted from my Monroe Co Circuit Court Records Vol 4 (c). Laura GRAVEN vs Robt S GRAVEN- Case 311, filed 17May 1894. -Divorce. Married abt 14 July 1892; separated in 1893. Typical statements of cruelty. Deposition of Powell PERDUE, 24 May 1894 - knows the parites - he spent all his money and whiskey. Deposition of Nancy MATTHEWS, same time. 37 years old, parties lived in her house for a time. He cursed, abused, etc. Married about a year. Was questioned if the rumor was true that his first wife's children attempted to poisen her break. Yes. Deposition of J H MATTHEWS, same time. 16 years old. No other information. File 311, no file date. William S SHIRLEY vs Bettie J SHIRLEY. Married Sept 1888, separated July 1893. She charged with lascivious [s] conduct - she left him. Three children: a girl about 3 named Ella; a boy named Cloy about 2 and a boy named Hezekiah-no age shown. Asks for divorce. No resolution found in rescued file. Sandi
