In
the name of God Amen I John Burton of Jefferson County and
State of Kentucky enjoying my senses perfectly by knowing
the uncertainty of this mortal life, do make and ordain
this my last will and testament in the following To
wit first. I
have given my daughter Mary Snell two hundred pounds in
land and other good property, likewise I have given my son
Reuben Burton two hundred pounds in land and one negro
girl named Sary, likewise I have given my son Jeremiah
Burton two hundred pounds in land and one negro boy named
Billy, likewise I have given my daughter Frankey Bohannon
one negro Woman named Judy and one negro boy named
Sampson I also lend her one mulatto girl named Sinea
during her life and then to be equally divided amongst all
her children is all worth two hundred pounds — Item I
give my son John Burton
my half of the grist and saw mills and one negro boy named
George to make him equal with the rest of his
brothers and sisters. Item, I give my son James Burton one
negro girl named Easter and after my death and my wife
Elizabeth then I also give him the land and plantation
where on I now live containing one
hundred and ninety five acres to make him equal with the
rest of his brothers and sisters — my will and
desire so that my loving wife Elizabeth Burton continues
in Quiet possession of all the rest of my worldly goods
during her life or widowhood. Then
it is my will and desire that after her death that the
residue of estate be equally divided into six equal parts
amongst my six children above mentioned though it is my
will and desire that my daughter Mary Snell's part shall
only be lent to her - her lifetime and then equal divided
amongst all her children also it is my will and desire
that my daughter Frankey Bohannon's part be also lent
during her life and this be equally divided amongst all
her children. Lastly, I nominate and appoint my friends
Reuben Burton, Jeremiah Burton, John Burton and James
Burton Executors to this my last Will and Testament in
Witness whereof I have hereto set my hand & Seal this
nineteenth day of December One thousand eight hundred and
nine.

A
writing purporting to be the last will and testament of
John Burton decd was this day produced in Court,
and provin [sic] by the oath of Robert Buckner with the
hand writing of Thomas Buckner, Ambrose Buckner and
William Buckner the subscribing Witnesses thereto and that
the Subscribing Witnesses are all dead. It is therefore
ordered that said Will be received and recorded as the
last Will and Testament of John Burton which is done
accordingly.
