1855
I James Moore of Scott county Kentucky being of sound mind and
dis***ing memory do make and publish this my last will and testament
as follows to wit.

1st I desire all my just debts be paid.

2nd I give and bequeath unto my beloved wife Judith Moore one
third of my landed estate to be laid off in such manner as to
include the dwelling house and the other necessary buildings on
the premises, also my negro man Anderson and my woman Eveline. I
also desire that my wife shall have the privilege of selecting
from amongst my stock in hand at my decease two of the best work
horses and two of the best milk cows and also from amongst my
household furniture farming utensils and fixtures all such as
she may need for the purpose of using enjoying and cultivating
her third of my landed estate. I desire that my dear wife shall
have the sole control use and benefit of the aobve mentioned
property both real and personal during her life and at her
decease I desire that my son John T. Moore and his heirs shall
have the said woman Eveline above mentioned together with all her
increase from and after this date. And all the balance of the
property willed my dear wife as above both real and personal at
her decease shall revert to my estate and be equally divided
amongst my children or their heirs.

3rd It is my wish and will that if my beloved wife shall prefer
in the place of the above provision two thousand dollars in cash
and as much of my household furniture as she may choose with
which to do as she may think proper. Also for and during her
natural life the two negroes Anderson and Eveline above named and
one of my best horses of her own choosing she shall have the
liberty of doing so. And in case she prefers the latter instead
of the fromer provision I desire and direct the said two negroes
and horse selected by my dear wife be disposed of as directed in
the 2nd clause of this my last will at the decease of my said
wife. That is I direct that at the death of my beloved with the
negro Eveline with her increase from this date shall belong to my
son John T. Moore and his heirs and the other negro Anderson and
horse selected shall revert to my estate and be equally divided
amongst all my children.

4th My will and desire is that if my dear wife shall choose to
accept the latter of the above provisions made for her that the
whole of my landed estate be equally divided amongst all my
children. If any of them be dead at my decease their portion I
desire shall in that event go to their heirs. But if my sons
Harvey Moore and John T. Moore shall think proper it is my wish
and desire that they shall have the privilege of purchasing of
all my other children their interest in my landed estate
abovementioned provided they can agree with them as to price
payment etc.

5th I give and bequeath unto my son Robert A. Moore and his heirs
my negro women Harret and Leah and all their increase from and
after this date.

6th I give and bequeath unto my daughter Mary J. Adams and her
husband Robert C. Adams and heir heirs my negroes Ellen and Queen
which they now have in their possession and their increase from
and after the time said negroes first came into their prosession.

7th I give unto my son Harvey Moore and his heirs my negroes
Waller and Lucy and their increase from this date.

8th I give and bequeath unto my daughter Eliza Ann Moore and the
heirs of her body my woman Maria and a small girl Parthena and their
increase from and after this date.

9th I give and bequeath unto my son John T. Moore (in addition to
Eveline as given him on the death of my beloved wife) my negroes
Reuben and Joseph.

10th I desire that the residue of my estate be sold at public
sale and the proceeds after paying all my just debts be
apporpriated to equalizing my children according to my estate
book which exhibits the allowances made to each of my children and
which advances I desire accounted for by each of them on a final
settlement and distribution of my estate. Said estate book I make
part of this my last will and testament.

Lastly I hereby constitute and appoint my sons Harvey Moore and
John T. Moore my executors to execute this my last will and
testament and I hereby empower them to do all acts and to make
and execute all writings necessary to carry this will into full
effect.

In testimony whereof I have hereunto set my hand and affixed my
seal to this my last will and testament this 26th day of April
1855.

A writing perporting to be the last will and testament of James
Moore was this day produced in open court and proved by the
______ of M. Polk one of the subscribing witnesses thereto who
also testified to the attention of J. S. Polk the other
subscribing witness and ordered to be recorded.

November 6th 1857
Appraisment of the personal property of James Moore deceased.
The ??? appointed by the Scott County Court, Rowan Snell and
John Sheely personally appeared before me a Justice of the peace
in and for Scott Co were first sworn then proceeded to appraise
the said property.

Mentioned were notes on James McKenilough(?), lots of personal
household items and farm gear, a total of 90 yds of carpeting,
13 mules, bags of wheat and corn, 4 cows, 1/2 bull!!!!, 5 horses,
31 sheep... etc.

This account was signed by Rowan Snell and John Sheely.

November 10th 1857
Several pages of the sale of the above personal property.
Buyers were Offutt, Adams, Risk, Barkley, Crawford Moore bought
the 1/2 bull, J.J. Moore bough half the sheep, J.T. Griffith
bought the rest of the sheep and the mules. H.H. Pruitt bought 18
geese, R.A. and J.H. Moore bought quite a bit also --- they
were his sons. Again Rowan Snell and John Sheely were involved
in the sale of the personal property.

here. Crawford Moore acct for 10.00, G.G. Whitehead had some,
Risk had $133.90, R.C. Adams had some.

Several other pages show the equalization of the funds due
each other and all involve the same people: Robert A. Moore
Mary J. Adams, Eliza J. Parks, James H. Moore, and John T.
Moore.

Again, the appraisers Rowan Snell, John Sheley, and a new one
was added: W.W. Allen.

Interesting fact: on this page it is John Sheley II

Also, the will names Harvey Moore but not the settlement and
the settlement names James H. Moore but not Harvey.
Conclusion: James H. Moore is James HARVEY Moore.
