James William Gough's will.  He was born ca. 1815 in Woodford Co. and died there ca. August/September 1844.  He was unmarried.

 

JAMES W. GOUGH: I James William Gough of the County of Woodford and State of Kentucky do make and publish this my last will and testament hereby revoking all others -- Item 1st I wish all my just debts first paid out of my estate by my executors [sic] -- Item 2d I give to my niece Rebecca Ann daughter of my brother John one sett [sic] of silver spoons which my brother John has in his possession. I also give her two hundred dollars to be paid her by my executor -- Item 3 Whereas my brother Frank has tenderly nursed and watched me with great trouble during my tedious illness I wish him to receive proper compensation for the same one hundred dollars is too little but I put it at that -- Item 3 [sic] I give to my brother Frank seven hundred dollars which he is to hold for the use and benefit of my brother Silvester [sic]. He is to hold the same and use it to the best advantage and give the proceeds thereof to the said Silvester [sic] but the principal is not to be appropriated unless my brother Frank chooses to give it to him my object in so devising this to my brother Silvester [sic] is not for lack of confidence or affection to him but because he is embarrassed and I am unwilling to let his creditors have the little sum I can give to him -- Item 3 [sic] give to my sister Sarah M. eight hundred dollars but in as much [sic] as I have acted as her guardian and in educating her I have spent about five hundred dollars over and above her income now if she or her guardian or husband should attempt to hold my estate responsible for so doing then the amount for which I have made myself responsible is to be deducted form the above eight hundred dollars. I also give my sister Sarah M. one good saddle horse and a gold watch suitable for a lady for which I wish my silver watch exchanged paying the difference between them. I also give her my bedstead and its furniture. Item 4 The balance of my estate except my buggy and what little furniture I have in my room I give to my brother Frank I wish to be equally divided between my brothers Frank Churchill and Benjamin but if it should so happen that after the other legacies are paid there should not be enough to make them eight hundred dollars each then the first legacies shall all be proportionably [sic] reduced so that those three and Sarah shall receive an equal amount of money. But the sum I give to Benjamin I wish to be held by my brother Frank until Ben becomes of age. And I wish Frank to use either the principal or the interest on it according to his discretion for the education of Benjamin. Item 5 -- The bequests I have made to my sister Sarah I wish my brother Frank to take charge of as her trustee and I wish him to hold the same for her use and benefit exercising his discretion in the same giving her the interest on it and if he chooses the principal but if he thinks it more to her advantage holding the principal in his own hands and given her the proceeds only. Item 6 -- I hereby appoint my brother Frank my executor to this my last will and testament. Signed sealed and published this 24th day of August 1844. Signed by James W. Gough....
