ADAIR COUNTY DEEDS & INDENTURES

This deed of Indenture made and entered into this 4th day of December in the year of our Lord 1847 by and between Samuel Morris and Sally Morris his wife of the County of Adair and State of Kentucky of the one part and James Morris of the County and State aforesaid of the other part  Witnesseth that the said Samuel and Sally Morris his wife for and in consideration of the sum of Three hundred dollars to them in hand for and by the Said James Morris the receipt whereof they do hereby acknowledge confessing themselves fully paid and satisfied have given granted bargained sold conveyed and confirmed and by there presents do give grant bargain sell convey and confirm unto the Said James Morris his heirs and assigns forever a certain tract or parcel of land situate lying and being the County and State aforesaid on the waters of Russells Creek and bounded as follows

“To wit Beginning at a white oak in John Holladays line thence S 98 ½ E 108 poles to a white oak and dogwood thence S 95 ½  W 47 ¾  poles to an Elm tree in a lane thence S ½  W 88 Poles to an Elm and hickory on the bank of said creek.  Thence up the same S88 E 15 poles to a sugar tree and white oak on a bank of Rocks on the bank of said creek thence S 70 E 97 poles to two sugar trees and hickory thence N 19 E 130 poles to a white oak and two dogwoods thence N 33 E 30 poles to a black walnut and poplar corner to Joseph Holladay Thence with his line N 65 ½  W24 ½  poles to a sugar tree and corner to the Said Holladay thence with his line N 36 W 857 poles to a large black oak another corner to the Said Holladay thence with his line N 55 W 67 poles to a black gum in John Cabochons (?) line and corner to the Said John Holliday thence with his line S 7 ½  W 35 poles to the Beginning Containing ninety seven and a half acres more or less with its appurtenances to have and to hold the Said tract or parcel of land with all and singular the appurtenances and all things appertaining thereto with this exception that the Said Samuel Morris and Sally Morris his wife shall keep the dwelling house that they now occupy and ten acres of land around and adjoining said dwelling house for the sole use and benefit of the Said Samuel Morris and Sally Morris during their natural lives and they also reserve for themselves a lien on the within mentioned land as Security for the payment of said land and the said Samuel Morris and Sally Morris his wife for themselves their heirs do herby covenant and agree that they will warrant and forever defend the right title and claim of the aforesaid tract or parcel of land against the claim of themselves their heirs or any other person claiming by through or under them and against the claim or  claims of all and every person or persons whatever unto the aforesaid James Morris his heirs and assigns forever for his and their only proper use benefit and behoof without any reservation except the occupying of said house and ten acres by said Morris and wife during either of their lives.  In testimony whereof the said Samuel Morris and Sally Morris his wife have herunto sit their hands and affixed their seals day and year within the first written.

I William Caldwell Clerk of the County Court for the county aforesaid do certify that this day this deed from Samuel Morris and Sally his wife to James Morris was produced to me in my office and acknowledged by said Morris to be his act and deed and the said Sally being examined by me privately and apart from her said husband declared that she did freely and willingly seal and deliver the said writing and wished not to retract it and acknowledged that the same again shown and explained to her to be her act and deed and ___________  that the same may be recorded.  Wherefor I have recorded the said deed with this certificate in my office.  Witness  my hand this 29th day of December 1847.

This deed or indenture made and entered into this 2nd day of December 1847 by and between Samuel Morris and Sally Morris his wife of the County of Adair and state of Kentucky of the one part and William Morris of the County of Cumberland and state aforesaid of the other part Witnesseth that for and in consideration of the sum of Three hundred and Sixty dollars to them the said Samuel Morris and Sally Morris his wife in hand paid by the said William Morris confessing themselves fully paid and satisfied the receipt whereof they do hereby acknowledge have given granted bargained sold conveyed and confirmed and by these presents do give grant bargain sell confirm and convey unto the said William Morris his heirs and assigns forever a certain tractor parcel of land situate lying and being in the County and state aforesaid on the waters of Russell Creek, being part of the survey ___ the said Samuel Morris and Sally Morris his wife now lives on and bounded as follows:  To wit;  Beginning at an elm and hickory on the bank of said Creek, running thence NE 88 poles to an elm in a  lane thence N 25degrees E 47 ¾ poles to a white oak in a line of John Hollidays survey thence with the same S 41 degrees W 8 poles to a white oak corner to said Holladay thence with his line S 22 ¾ degrees W 104 poles to a small buckeye sapling on the bank of said creek and corner to said Holladay thence up said Creek with the meander thereof S 34 degrees W 48 poles thence S 6 degrees E 52 poles thence S45 degrees E 34 poles thence S 88 E 68 poles to the beginning containing one hundred acres more or less with its appurtenances to have and to hold the said tract or parcel of land with all and singular the appurtenances and all thing appertaining thereto and the said Samuel Morris and Sally Morris his wife for themselves their heirs and do hereby covenant and agree that they will warrant and forever defend the right title and claim of the aforesaid tract or parcel of land against the claim of themselves their heirs or any other person claiming by through or under them and against the claim of all and every person or persons whatever unto the aforesaid William Morris his heirs and assigns forever, for his and their only proper use benefit and behoof.  In testimony whereof the said Samuel Morris and Sally Morris his wife have hereunto set their hands and affixed their seals day and year first written within.

    I William Caldwell Clerk of the County Court for the County aforesaid do certify that this day the foregoing deed from Samuel Morris and Sally Morris his wife to William Morris was produced to me in my office and acknowledged by the said Samuel Morris to be his act and deed and the said Sally Morris being examined by me privately and apart from her said husband declared that she did freely and willingly seal and deliver the said writing and wished not to retract it and acknowledged the same again shown and explained to her to be her act and deed and consented that the same might be recorded.  Whereupon I have recorded the said deed together with this certificate in my office.  Witness my hand this 2nd day of December 1847.
