This indenture made and entered into by and between John L. James and Emily, his wife, 
the second (sic "first") part & Sarah James(?) of the second part, witnessith that for and in 
consideration of the sum of three hundred dollars in hand, paid the receipt of which 
is hereby acknowledged, for which the party of the first part have bargained and sold 
unto the party of the second part a certain tract of land lying and being in Carter 
County and being the same land deeded to the party of the first part by Zachariah Tyree, 
Commissioner, and bounded as follows, to wit: Beginning at 3 black oaks in west line of 
survey & corner of lot no. 3, S 47 E 38 poles to white oak on ridge, N 50 E 18 poles 
to hickory and white oak S 51 E 86 poles to white oak hickory and elm, William James 
corner, N 53 E 16 poles to beech and dogwood, N 41 E 24 poles to one black walnut, a 
corner of lot no. 5, N 24 W 42 poles to two small white oaks, one black oak, red oak 
S 88 W 47 poles to black walnut, sugar tree & Gum, N 4 ? E 38 poles to one gum and black 
oak, N 17 1/2 W 30 poles to two dogwoods & gum in line of lot No. 1, with same N 3 E 20 
poles to a stake, corner of lot no. 2, S 51 W 122 poles to the beginning, containing by 
survey, 68 acres, being lot no. 4 in the division of land of George James, dec., to have 
and to hold unto her, the party of the second part and to her heirs and assigns forever 
and the parties of the second part will warrant and defend against all persons claiming 
under or through themselves, their heirs, forever, unto the part of the second part, but 
against no other claims whatever. Given under our hand this 10th day of October 1857.

	I Elias P. Davis, Clerk of the County Court in and for the county aforesaid, do certify 
that this deed from John L. James & Emily, his wife, to Sarah James, was this day produced in 
my office and the said John L. James acknowledged his signature to be his act & deed for the 
purposes herein mentioned & Emily James, his wife, being exmined by me seperate and apart from 
her husband declared that she did freely and willingly sign, seal & deliver said writing and 
acknowledged said writing being again shown to her to be her act and deed for the purposes 
herein mentioned & said she did not wish to retract it & consenteth that the same may be recorded, 
Wherefor said deed together with this certificate hath been duly recorded in my office, Given 
under my hand this 16th day of Oct 1859.
