Declaration of James Horsley

 

               States that he lived in Culpepper County Va. and substituted about the year 1780 or 81 as Militia man to gard prisioners at the Albarmarl Barreck (?) Virginia & was then discharged after serving out my time which I think was three months & returned home Conn was Capt at the Barrock, the other officers names I have forgotton. I then substituted on a second tour for three months in Culpepper County Va, & was marched from there to Petersburg thence to Springfield & thence returned to Culpepper again & from thence I was marched to Williamsburg. I was then marched to a Redoubt between Yorktown & Pigenon Hill which the Brittish had in possession which we succeded in taking. I was thence marched to Yorktown; at which place I enlisted as a regular soldier for five years during the war. I think I was enlisted by a man by the name of Arnold who was a recruiting officer at that place, my officers of my second toures were Col. James Barber or Basher Majr. John Gray (?) Capt Thomas Watts Lieutenant Blake Ensign Rubin Winn, Capt Watts resigned after I had been in the service some time & Jasper Hanes succeeded him as Capt and served Capt until my term of service expired, that I had substituted for. (?) days after I had inlisted I was marched against Lord Corn Wallis who was then in the possession of York Town and Glocester on the opposite side of the River. In making the attact the American Army was divided in Two divisions the French having assigned to them command of one of the divisions & the Americans the other. I was in the French division that was commanded by Marquis De St Simon & Layette both divisions was successful & Wallis was forced to surrender I was within 30 or 40 feet when Wallis give up his sword & I think it was returned again by Washington to Wallis. This Battle I think was in the fall of 1781 or 82. I was then marched from YorkTown Cloves Marsh in S. Carolina my officers at that time was Capt Connet Blue Robert Colvin Serjant & Stuben or some such name was my Col. my mess mates during the greater part of my regular service was Joseph Grace William Sulivan and William Estil I have a very distint recollection of these men messing with me. before I was Discharged I was marched from Cloves Marsh to Richmond Va. and was there Discharged & my Discharge was there handed and about Thirty five years ago my house was burned down & my Discharge was burned up among a great many other valuable papers on Licking River Bath County Kentucky.

                              I Samual Ratcliff a Justice of the Peace in and for the County aforesaid do certify that the foregoing Declaration of James Horsley was taken subscribed and sworn to before me on this day That I have been personally acquainted with said James Horsley for sixteen years each past That he is a resident of Greenup County in the State aforesaid, and is a neighbour of mine That he is a high minded honorable man, and that I have no doubt of the trouth of his declarations as above.

                              I William Corum Clerk of the County Court of Greenup County in the Commonwealth aforesaid do certify that Samuel Ratcliff who has given and subscribed the forgoing certificate now is, and was at the time of signing his name,

one of the justices of the peace, in and for the County aforesaid, and one of the Judges of said Court, duly commissioned and sworn, and that as such, full faith and credit are due and ought to be given to all his official acts, as well within courts of Justice of this county.

In Testimony whereof I have here unto set my hand and affixed the seal of the County aforesaid the 20th day of January 1843 and in the 51st year of the Commonwealth.

This is to certify that James Horsely whose Declaration is on the forgoing page is well known to me as a man refuted to have served in the Revolutionry War. He has ever been esteemed by all his neighbors as a man of high integrity and honesty. A man of the Strictest morals and Religious habits. Elijah Horsley whos deposition is also herein filed is also well known to me, and is as fully entitled to credit as a witness as any man in the State of Ky. They are each citizens of the County of Greenup State of Ky.

Deposition of Elijah Horsley who is about eighty years of age taken at the House of Samuel Ratcliff Esqr Greenup Co. Ky on the (?) of December 1842 to be used as evidence in obtaining a pension for James Horsley an old Revolutionary Soldier after being first Duly sworn deposeth and sayeth. That he was present when James Horsley enlisted near York Town Virginia as a Regular Soldier in the Revolutionary war for five years or during war. I was not in the Army myself. I saw James Horsley frequently during his servitude and believe he was in the Battle at YorkTown, and he was after the taken of York Town marched to south Carolina, I have frequently seen his Discharge and believe it to have been an honorable one and further this Despondent sayeth not.

                              I Samuel Ratcliff a Justice of the Peace in and for the County aforesaid do certify that this foregoing deposition of Elijah Horsley was this day taken subscribed and sworn to before me, and that I am personally & well acquainted with the said deponent and have been for about 15 or sixteen years and he resides in the county aforesaid Given under my hand this (?) day of December 1842
