Last Will and Testament

Of

David Davis

 

 

I, David Davis of Smokey Valley, Carter County, Kentucky, being of sound mind but feeble body and in poor health make this my last will and testament hereby revoking all former wills.

 

First

I hereby give and bequeath to my two girls, Easter Ann and Alice Ellen Davis, the following described tract of land lying in the County of Carter and State of Kentucky on the waters of Smokey Creek bounded as follows: Beginning at two beeches in the Schoolhouse yard thence a strait line a due west course to Stephen Davis line thence south with said Stephen Davis line to John W. Williams line thence with John W. Williams line to the old survey thence with the line of the old survey to the beginning corner.

 

Second

I hereby give and bequeath to my two sons, Hiram Davis and William S. Davis, the following described tract of land lying on the waters of Smokey Creek in Carter County, Ky. and bounded as follows: Beginning at two beeches in the Schoolhouse yard thence west with the line of the tract of land given to my two girls, Easter Ann and Alice Ellen to Stephen Davis line thence north with said Stephen Davis line 40 rods thence due east across the farm to a hickory sapling standing in the corner of the fence thence with the old line to the beginning.

 

Third

I hereby give and bequeath to my dear wife, Amanda Jane Davis and my three children Clora Elizabeth, David York and Maryan Susanna all the remainder of my home farm: Beginning in the old line at the corner of the tract I give to my two sons, Hiram and William S. Davis; thence with their line through the farm to Stephen Davis line with said Davis line north to James Gilbert's line thence with said Gilberts line to Stephen Erwins line thence with old survey to the beginning.

 

Third

I also give and bequeath to my dear wife Amanda Jane Davis and the three children named above all my personal property excepting one cupboard, one sewing machine, one side saddle and one bureau I give to my girl, Easter Ann, one side saddle and my cubbard I give to my girl, Alice Ellen my bureau and sewing machine.

State of Kentucky Carter County I, W. H. Mocabee, Clerk of the County Court do certify that the foregoing will of David Davis, deceased was on the 14th day of February 1898 produced in open court by Stephen Davis and John W. Danner and by their oaths proved the same to be the last will and testament of David Davis, deceased and that David Davis heard the said will read to him before he signed the same and that he signed the same in their presence and that he was of sound mind and deposing memory at the time of signing same whereupon the Court ordered that said will be admitted to probate whereupon the same and this certificate hath been duly recorded in my office. Given under my hand this February the 14th, 1898 /s/ W. H. Mocabee, Clerk.
