Peter, a man of colour

Muhlenberg County Court April 17, 1813
The Commonwealth against Peter a man of colour, the property of William Worthington, Esq., upon an attempt to commit a rape on the body of Judith Langley
The prisoner was led to the Bar in custody of the Jailor and thereof arraigned who pleaded not guilty and for trial hath put himself upon his Country and the Attorney for the Commonwealth doth the same. Whereupon let a Jury come &c. and thereupon came the Jurors of a Jury (towit) Hendley W. Moore, James Unsell, Henry Unsell, Westley Thomas, Samuel Chinoweth, David Robertson, Jacob Anthony, Thomas Bell, William W. Smith, Michael Goodnight, Britan Willis and Daniel Lomdes(?) who being Elected tried and sworn the truth to speak and true deliverance make between the Commonwealth and the prisoner of the Bar upon their oaths do say that the said prisoner is not guilty. Whereupon it is considered by the Court that the said Defendant be altogether discharged from this prosecution.

Brown, W.T.

Muhlenberg County Court January Term 1881
A paper purporting to be the last will and testament of W.T. Brown Decd. was produced to Court and proven to be the Act and deed of said Decedent by the oaths of J.R. Depoyster, F.N. Isbell and Jno. E. Reno the Three subscribing witnesses thereto and ordered to be recorded.

On motion of Samuel Brown It is ordered that he be and he is hereby appointed Executor with the will annexed of W.T. Brown Decd. who thereupon took the Oath prescribed by law and Executed bond Conditioned according to law with H.T. Reno, J.F. Jarvis, W.F. Tyson, Jas. J. Brown and M.H. Capps as his surety which was approved by the Court.

On motion of Saml. Brown Extr. of W.T. Brown with the will annexed It is ordered that F.W. Isbell, Riley Depoyster & J.M. Williams be and they are hereby appointed appraisers of the personal property of said Decedent any two of whom after being full duly sworn may act.

On motion of Samuel Brown, It is ordered that he be and he is hereby appointed Guardian to Nathanial Brown a minor over 14 years of age who appeared in open court and made choice of said Guardian who thereupon took the oath prescribed by law and executed bond, conditioned according to law with J.B. Millard as his hurety which was approved by the court.

On motion of Samuel Brown, It is ordered that he be and he is hereby appointed Guardian to Wm. T. Brown a minor over 14 years of age who appeared in open court and made choide of said Guardian who thereupon took the Oath prescribed by law and Executed bond conditioned according to law with J.B. Millard as his surety which was approved by the Court.

Byrd, John

9 August 1813
Stephen Wiley and Hardy Hynes came into Court and acknowledged themselves securities for Rebecca Hynes (late Rebecca Byrd) who was widow and relict of John Byrd Deceased in the room and place of Robert Glenn one of the former securities of the said Rebecca as Executrix of the said Decedent in the penalty of three hundred Dollars, Conditioned as the law directs. Whereupon the said Robert Glenn from his undertaking or obligation is altogether exonerated or discharged.

Clark, Daniel to Robert Clark

10 January 1814
An Instrument of writing purporting to be a Bond acquittance or Discharge from Daniel Clark of the one part to Robert Clark son of said Daniel Clark of the other part was produced in Court and proved by the oaths of Jesse Reno and Robert Randolph two subscribing Witnesses thereto to be the act and Deed of the said Daniel a party thereto Which is thereupon ordered to be [a] deed of Record.

Davis, A.N. to William B. Davis

The Commonwealth of Kentucky > I, A.N. Davis of the County of Muhlenberg and state aforesaid, do by these presents empower W.B. Davis of Smith County, Tennessee to collect and receive all money etc. due my ward, John S. Lucas, he having removed to this State and chosen me his guardian instead of his former guardian James H. Davis who also lives in Smith County, Tennessee. The above named Wm. B. Davis having all the power to collect, receive and settle with guardian that I would have if present. I also empower [him] to make settlement with the clerk if it becomes necessary and with Said Guardian James H. Davis. Witness my hand etc. this May 12th 1856

Lucas by the Muhlenberg County Court Guardian for Said J.S. Lucas and that sd John S. Lucas lives in this County and State aforesaid

Bogess whose Signature appears to the foregoing certificate is and was at the time Protem Judge of the Town of Greenville Duly commissioned and Sworn and that all his official acts as such are entitled and should have full faith and credit and that his said signature is Genuine

Contributor's Notes: The ward in the above document is a nine year old boy named John S. Lucas, who much later appears in the 1880 census of Greenville, Muhlenberg Co., Kentucky. There he is recorded as 43, born in Missouri about 1837 to a father born in Missouri and a mother born in Tennessee. He was married to a Rosalind, aged 47, born in Kentucky. According to the Guffey Board at Ancestry.com, she was born Rosalinda Maria Guffey. She married John S. Lucas in Muhlenberg Co., Kentucky about 1857, and died about 1893.

The Davises were a Tennessee family, but it is not known whether Lucas' mother was a relative. Arthur Nathan Davis (1823-1868) is here empowering his younger brother, William Britten Davis (1829-1916) of Brush Creek, Smith Co., Tennessee, to settle accounts with their older brother James Harvey Davis (1819-1888) who had previously been Lucas' guardian.

From James' first marriage about 1835 until his wife's death about 1842, he had lived in Missouri, which is likely where he connected with young Lucas. He also had at least two sons by that marriage, John Davis born c. 1837 and Lemuel Davis born c. 1841 in Missouri. They all returned to Brush Creek in 1842 and he remarried and had a second family. By the date of this document, he had at least eight children in his combined families; at the time and for a period afterwards, Arthur N. Davis and his wife had only three.

It might be noteworthy that in the 1880 census, Lucas' household is living right next door to Thomas C. Newman (and family), nephew by marriage of Arthur N. Davis, married to Eliza Ann Newman (1825-1889).

Muhlenberg County Court December Term 1870
On motion of John Davis by Samuel E. Smith his Attorney a Rule is awarded against John A. Towns Marshall of the Town of South Carrollton to appear before the Judge of the Muhlenberg County Court in the town of Greenville at the next regular term of this Court to show cause if any he can why he shall not be required to Execute a new official Bond as Marshall of said town and release said Davis from further liability on said Bond as one of his Sureties.

Dobyns, John

10 January 1814
On the motion of Lew Dobyns (Theodocia Dobyns widow & relict of John Dobyns Deceased having refused the burden thereof) who made oath as the law directs Certificate granted him for obtaining letters of Administration on the estate of said Decedent who thereupon together with Eppes Littlepage and Andrew Vance his securities executed their Bond to the Commonwealth of Kentucky in the penal sum of Four hundred Dollars Conditioned as the law directs.

Drake, Leander, a Negro Boy

Muhlenberg County Court December Term 1870
On motion of John Shutt, It is ordered that the Clerk of this Court enter into Indenture of apprenticeship with said Shutt binding unto him a Negro Boy named Leander Drake aged 13 years the first day of last May to learn the art and trade of farming until he shall attain to the age of 21 years. That this Indenture shall contain all the covenants required by Law Thereupon said Bruce Clerk as aforesaid and said John Shutt acknowledged in open Court an Indenture according to this Order and the same was ordered to be recorded.

Fentress, John

8 December 1813
On the motion of John Fentress, It is ordered that a Ferry be established at his house on a Bluff on Green River formerly Randolph's old Bluff whereof said Randolph formerly kept a ferry, upon his entering into bond at the Clerk's Office of said County with Colston O. Willis and William Cross as his securities who thereupon together with the said Colston O. Willis & William Cross entered into and acknowledged their bond.

On the motion of John Fentress leave is granted him to keep a Tavern at his house in Muhlenberg County on Green River, who thereupon together with Colston O. Willis and William Cross Sr. his securites, entered into and acknowledged their [bond] in the penalty and conditioned as the law directs.

John Fentress lists for taxation for the year one thousand Eight hundred thirteen the annexed property (to wit) two hundred Sixty two acres of third rate land lying in [blank - probably Muhlenberg] County on the waters of Green River entered in the name of [blank], Surveyed in the name of George Tennill, and Three Thousand Acres of land same rate in Breckenridge County on the Waters of Rough Entered, Surveyed and Patented in the name of Matthew Walton, one Black above the age of sixteen years, Three total blacks, one white male above the age of Twenty one years and Twelve head of horses which is Ordered to be Certified to the Auditor of Public accounts and the Sheriff of this County.

Fentress, Lancaster D.

Proof was this day made in open Court by the oaths of Abner Gore & Matthew Wilsono that Joseph Saunders a Revolutionary Pensions resided & died in Bullitt County Ky. on the 13 day of Augt. 1838 and that he left the following named persons his children & heirs: Nathaniel O. Saunders, Behethlam [sic] who intermarried with John Lucky, Thomas J. Saunders, Julia who intermarried with Joseph R. Murray, Susan who intermarried with John Barnes, Sarah who intermarried with Chs. W. Dozier and Nancy intermarried with Lancaster D. Fentress and Nancy has since died leaving sd. Lancaster her husband and the following children Ellen S. Fentress, Wm. D. Fentress, Jno. Tho. Fentress & Frances Josephine Fentress.

On the motion of Lancaster D. Fentress, he is appointed Guardian to his Infant Children, Ellen Saunders Fentress, Frances Josephine Fentress, Wm. Dozier Fentress, who thereupon _____ bond in the penal sum of One hundred dollars with John Barnes his security conditioned agreeably to law.

It was this day proved in open Court by the oath of George F. Pope that Joseph Saunders, late a pensioner of the United States for Revolutionary Services, departed this life (no widow and left) leaving the following named persons as his children and heirs towit: Nathl. P. Saunders, Bepiland married to John Lucky, Thomas J. Saunders, Julia married Joseph R. Murray, Susan married to John Barnes, Sarah married to Charles W. Dozier and Nancy married to Lancaster D. Fentress and that since the death of said Joseph Saunders, the said Nancy Fentress has died leaving the said Lancaster D. Fentress her husband and the following infant children: Ellen Saunders Fentress, Frances Josephine Fentress, and William Dozier Fentress - and Abner Gore being also sworn in open Court proved that the aforesaid Joseph Saunders departed this life on the 13th day of August 1838 - and that the sd. Saunders is the identical person named in original Certificate now here to this Court shown having date the [blank] day of [blank] and signed by Lew Cass[?] Secretary of War granting to said Jos. Saunders a pension of [blank] per annum and No. [blank].

Morehead be and they are hereby appointed appraisers of the personal Estate of said Decedent any two of whom being first duly sworn may act. Herrin, David

11 October 1813
William Wilkins appeared in open Court and being first sworn Deposeth and saith that some time in the month of August last he was at the house of Stephen Watkins in Muhlenberg County the place of residence of David Herrin, and in the last illness of the said David, and the said David Herrin called on this Deponent, Sion Jarvis and James Arnett and told us to take notice that he left all his property to Stephen Watkins except the amount which Charles Holmes and Bryant Holmes were owing him, which they, the said Charles and Bryant were to keep and further this Deponent saith not.

On the motion of Stephen Watkins who made oath as the law directs Certificate is granted him for obtaining letters of Administration on the Estate of Davis Herrin Deceased who thereupon together with Jesse Reno his security entered into and acknowledged their Bond in the penalty of three hundred dollars Conditioned as the law directs.

Ordered that Nehemiah Forehand, William Tanner, William Wilkins and Thomas Barfield or any three of them being first sworn Appraise in current money the personal estate and slaves (if any) of David Herrin Decd. & that the Administrator thereof return an Inventory of the same agreeably to law.

Hill, John

11 April 1814
On the motion of John Hill who proved himself the heir at law to his son John Hill Deceased who departed this life on his return from the expedition under his Excellency Governor Shelby attached to Captain Charles F. Wings company some time in the year eighteen hundred and thirteen which is Ordered to be certified accordingly.

Hope, Novella

At a Call Term of the Muhlenberg County Court, held at the Court House in Greenville, Kentucky, on August 5th, 1926, Hon. T.E. Sparks, Judge, presiding:

This day came Novella Hope and made a motion that she be allowed a sufficient sum of money to provide clothing and food for herself and baby, until she could obtain employment and earn a sufficient amount of money to support herself and infant child. The court in considering said motion interrogated various witnesses under oath and the facts disclosed were to the effect that Novella Hope is fifteen years of age; that Chester C. Hope, age 32, is her husband, and that he is afflicted with T.B. and unable to earn any money and further that he is separated from the said Novella Hope and not able to provide for support of his wife and infant child. And it further appearing to the court that Novella Hope is in destitute circumstances, that she and her infant child have no relations able to assist them, and it appearing in general that the welfare of said Novella Hope and her infant child is dependent on charity; it is not therefore ordered by the court that the County Court Clerk draw an emergency warrant on the general fund not otherwise appropriated, payable to the said Novella Hope to the amount of Twenty Dollars for the use and benefit of herself and her infant child.
It is further considered by the court that said Novella Hope and infant child could not be committed to the County Poor House without doing an injustice to the said infant child.

Hudspeth, Marjorie

Muhlenberg County Court, 9 August 1926, Hon. T.E. Sparks presiding:

On motion of Carrie J. Underwood, County Court Clerk of Muhlenberg County Kentucky it is ordered that Miss Marjorie Hudspeth be and she is now appointed Special Deputy Clerk; whereupon the said Marjorie Hudspeth appeared in open court accepted the trust and took the oath prescribed by law as such Deputy.

Fanny Hughes (late Fanny Davis) who was summoned to appear here at this court to give Counter security, who appeared accordingly and thereupon Arington Wickliffe, William Cross Sr., Jesse Hughes, and Colston O. Willis her securities entered into and acknowledged their bond in the penalties and conditions that the law requires.

On the motion of William Cross Sr. one of the securities of Fanny Hughes (late Fanny Davis) Executrix of Henry Davis Decd. It is Ordered that a summons issue directed to the sheriff of this county commanding him to summon the said Fanny as Executrix aforesaid to appear here at the next court to give co inter(?) security in the room & place of the said William Cross & others agreeably to law.

On the motion of Bennet D. Bailey (Milly Kincheloe the widow and relict of Lewis Kincheloe deceased having refused to take upon herself the burden of the Administration) who made oath as the law directs Certificate is granted him for obtaining letters of Administration of the Estate of said Kincheloe deceased who thereupon together with Lewis Reno Charles F. 9 May 1814
On the motion of the Reverend William Kincheloe who produced credentials of his ordination and regular communion with the Methodist Church he having heretofore taken the oath of allegiance to this Commonwealth, License is thereupon granted him to solemnize the rites of matrimony agreeably to law whereupon the said Kincheloe together with Lewis Reno & Jesse Reno his securities executed their bond in the penalty of Five hundred pounds Conditioned as the law directs.

Kirtley, Francis

14 July 1860

On motion of Daniel M. Kittinger it appearing that there is necessity for immediate action in the matter and Sarah Kirtley, widow & relict of Francis Kirtley, deceased, who died intestate, having waived her right of administration, it is ordered that by the court that administration on the estate of said Francis Kirtley, deceased, be and is hereby granted to the said Daniel M. Kittinger, who entered into & executed a covenant according to law with E.V. Kirtley, C.W. McLean, Alney McLean, L.R. Reno his sureties, and was duly qualified according to law.

It is further ordered that Cornelius Drake, Benjamin Drake and James C. Moorman are appointed appraisers any two of whom being first sworn may act, to appraise the personal estate, view and appraise the estate of said intestate and subscribe and return their appraisement to this clerk of the court according to law.

Kittinger, Andrew F.

Muhlenberg County Court December Term 1870
It appearing to the Satisfaction of the Court that Andrew F. Kittinger Stands improperly charged upon the Assessing Books for the present year with $333 on land. It is therefore ordered that he be exonerated from the payment of tax upon the same which is ordered to be copied & certified to the Sheriff and Auditor.

McCoy, Frank J.

Muhlenberg County Court August 9, 1926
This day came Sallie McCoy and waived her right to act as Administratrix of Frank McCoy, deceased, and moved the Court to appoint Arthur Bennett as Administrator of the estate of the said Frank McCoy, deceased, whereupon the said Arthur Bennett appeared in open court accepted the trust took the oath prescribed by law and together with J.M. Shaver and Henry Fentress as surety, therein entered into covenant with Commonwealth of Kentucky in the penal sum of $1000.00 conditioned according to law.

McNary, William

13 December 1813
On the motion of Ann McNary, widow and relict of William McNary Deceased and Hugh McNary who made oath as the law directs, Certificate is granted them for obtaining letters of Administration on the Estate of the said decedent who thereupon together with James Campbell, Hutson Martin and William Campbell Sr. their securities executed their bond in the penalty of Two thousand Dollars conditioned as the law directs.

Mitchell, Richard A.

Came Richard A. Mitchel, a minor over 14 years of age, child of W.A. Mitchel, and upon privy examination by the court, nominated W.A. Mitchel as his guardian, and the court hereby orders that he be and he is hereby appointed Guardian for said Richard A. Mitchel, whereupon he appeared in court, and took the oath prescribed by law and together with G.M. Bibb his surety, who is accepted and approved by the court, entered into and acknowledged bond to the Commonwealth of Kentucky, conditioned according to law.

On the motion of William Moore who made oath as the law directs Certificate is granted him for obtaining letters of Administration on the Estate of Abner Moore Deceased, who thereupon together with David Robertson his security entered into and acknowledged their Bond in the penalty of Five hundred Dollars Conditioned as the law directs.

Road leading to Willis Morgan's Mill

11 May 1812
A Report of the road to lead from Greenville to Willis Morgan's Mill on Pond River was returned into Court in the words & figures following, towit, “Agreeably to an order of the Muhlenberg February County Court appointing John Smith, John Whitmore, James Tanner & Willis Morgan to mark out and review a road from Greenville to Morgan's Mill after being sworn report as follows, that, they have viewed the road to strike out of the road leading from Greenville to Eppes Littlepage's on the land of William Croghan of Jefferson County and about one mile Eastward of Claiborne Rices running through the lands of the said Croghan, Charles Campbell, Charles Vincent, John Fishback of Clarke County, John Smith, Charles Morgan, Willis Morgan, Robert Wilkins, Samuel Tanner, William Bass and thence through the lands of Willis Morgan to his mill all the parties that are citizens of the County having given their consent May 11th 1812.” John Smith, John Whitmore, Willis Morgan viewers, and the Citizens owning the land through which the road runs having consented to the same, It is ordered that the same be established accordingly.

Phillips, Henry, a man of color

Muhlenberg County Court July 22, 1805
Samuel Russell came into Court & proved to their satisfaction that Henry Phillips a man of color is a free person he the said Henry being free born & having served the said Russell from the time of his infancy untill he arrived to the age of twenty one years which is ordered to be certified accordingly.

On the motion of Leah Saunders mother of George Saunders deceased who Departed this life in the campaign in the year 1815 & who was attached or belonged to Captain Alney McLean's company of drafted men under the command of General Andrew Jackson against the British at New Orleans said Leah Saunders having made oath as the law directs, Certificate is granted her for obtaining letters of administration thereon, who thereupon together with Handley Witmore(??) her Security entered into Bond in the penalty of Four(?) hundred Dollars, conditioned as the law directs.

Muhlenberg County Court January Term 1881
A paper purporting to be the last will and testament of R.C. Sharp Deceased was produced to Court and proven to be the act deed of the said R.C. Sharp Dec'd by the Oaths of S.R. Slater(?) and Ben C. Young the two subscribing Witnesses thereto And Ordered to be recorded.

On motion of J.M. Sharp It is ordered that he be and he is hereby appointed Administrator of R.C. Sharp Dec'd with the will annexed (the widow consenting thereto in writing) who thereupon took the Oath prescribed by law and Executed bond conditioned according to law with William C. Sharp and Robert N. Sharp as his sureties which was approved by the Court.

Muhlenberg County Court December Term 1870
On motion of Jesse H. Reno It is ordered that he be and is hereby appointed Adm'r of Josiah Steersman Dec'd who thereupon took the oath prescribed by Law and Executed Bond Conditioned according to Law with Joseph Ricketts as his Surety which was approved by the Court.

On motion of Jesse H. Reno Adm'r of Josiah Steersman Dec'd It is ordered that S.M. Eaton, Bradford Nofsigner & Jacob Shaver be and they are hereby appointed Appraisers of the personal Estate of said Decedent, any two of whom being first duly sworn may act. That they state within the appraisement the articles and value of each Set apart by them to the widow Seperate and apart from the articles appraise for sale and report to this Court.

Wilcox, Thomas

On the motion of James Wilcox who proved (to the satisfaction of the Court) himself the heir at law to his son Thomas Wilcox who expired some time in the year eighteen hundred and thirteen during the time he was on the campaign under his excellency the Governor Shelby attached to Captain Charles F. Wing's Volunteer Company which is ordered to be Certified accordingly.

Willis, Henry, a freeman of Colour

On motion of James Rothrock a citizen of this County and being desirous of Obtaining leave of this Court to take with him out of the State of Kentucky Henry Willis a freeman of Colour about 33 years of age and not being willing to leave his right of residence in Ky It is Ordered by the Court that said boy Henry may leave this Commonwealth for Temporary purposes and return again Without forfeiting his residence.

On the motion of Betsy Wooton widow and relict of Elijah Wooton deceased who made oath as the law directs Certificate is granted her for Obtaining letters of Administration on the estate of the said Elijah Wooton deceased on her giving bond and security according to law who thereup[on] together with Philip Murphey and John S. Graves her security entered into & acknowledged their bond in the penalty of Eight hundred dollars conditioned as the Law directs.
