455. Ephraim Dewitt(??) this day claimed a right to four hundred acres of Land agreeably to entry filed which is granted accordingly.

456. Henry Davis this day claimed a right to one hundred acres of Land agreeably to entry filed which is granted accordingly.

457. Martin Martin this day claimed a right to two hundred acres of Land agreeably to entry filed which is granted him accordingly.

Carneal Alcock came into Court and relinquished his Certificate No. 453 which was heretofore granted him by this Court.

458. Carneal Alcock this day claimed a right to four hundred acres of Land agreeably to entry filed which is granted him accordingly.

459. Rolly Day this day claimed a right to one hundred and fifty acres of Land agreeably to entry filed which is granted accordingly.

460. William Laws this day claimed a right to two hundred acres of Land agreeably to entry filed which is granted accordingly.

Ordered that the following hands towit Watts Conwen, Samuel Grigsby, Joseph Groves, John Grigsby, Toliver Grigsby, Willis Cornwell, Dempsey Cornwell, Frederick Phillips & W. Totterton be and they are hereby allotted to Peter Boggus [Boggess] Surveyor of the road from Greenville to Adairs Lick and that he together with the aforesaid hands and the hands heretofore allotted him open and keep the Same in repair fifteen feet wide as the Law directs & It is further ordered that the aforesaid hands be exempt from working on any other road.

On motion of William Henson it is ordered that a ferry be established on his Lands at the mouth of Muddy River across the Said Muddy River & Green River he owning the Lands on both Sides of Said rivers upon his giving bond and Security in the clerks office as the Law directs and that the rates of ferriage be as follows towit
for carring a man & horse across Green River - 12 5 [no monetary symbols given]
across Muddy river - 8 5
for a horse or man Single across Muddy river - 4 2½
for a horse or man Single across Greenriver - 6 2½

Michael Wilkins moved the Court to grant him a certificate for two hundred acres of Land and for reasons appearing to the Court It is ordered that the same be Continued until next Court.

Ordered that Isaac Davis, James Tinsly, Gilbert Vaught and Edward Williams or any three of them (being first sworn) do view and mark out the best & most convenient way for a road from Lewisberg to intersect the road leading from Smiths mill to Logan Courthouse and make report thereof as the Law directs.

Ordered that Lewis Kincheloe Esquire be and he is hereby appointed Commissioner for Muhlenberg County for the purpose of taking in a list of the Taxable property for the present year.

461. Philip Henson this day claimed a right to two hundred acres of Land agreeably to entry filed which is granted him accordingly.

Ordered that the Trustees of the Town of Greenville meet the commissioners appointed to Settle with them on the Saturday next before February Court next for the purpose of making the Said Settlement.

Ordered that William Tanner, Jacob Wiley, Lewis Reno & Lewis Kincheloe or any three of Them (being first sworn) do view and mark the best and most Convenient way for a road from Lewisberg to Intersect the road leading from John Randolph's ferry on Greenriver to Eppes Littlepages ferry on Pond River and make report thereof to the next Court as the Law directs.

Barnabas Wing's Stockmark a half crop in the upper side of the right ear on his motion is ordered to be recorded.

John Dobyn's Stockmark a Swallowfork in the left Slit & under bit in the right on his motion is ordered to be recorded.

Batten Dobyn's Stockmark a crop & slit on the right ear on his motion is ordered to be recorded.

Ordered that the following hands be and they are hereby allotted to work on the road from Greenville to Adairs Lick in addition to the former hands allotted towit Watts Corsvin(?), Samuel Grigsby, Joseph Groves, John Grigsby, Willis Cornwell, Dempsey Cornwell, Frederick Phillips & Thomas Tetterton & that they be exempt from working on Humphreys road.

Absent William Garrard Esquire

On the motion of William Henson It is ordered that a ferry be established on his Lands at the mouth of Mud River across the Said Mud river & Greenriver to the opposite Sides of both Rivers and that the said Henson or his assignee receive the following rates for a single man & horse across Mud river eight and a half cents & across Green River twelve and a half cents and a Single man or horse one half of the Same.

Michael Wilkins moved the Court to grant him a Certificate for two hundred acres of Land and for reasons appearing to the Court It is ordered that the Same be Continued until the next Court.

475. John Bryant this day claimed a right to eighty five acres of Land agreeably to entry filed which is granted accordingly.

476. Samuel Allison this day claimed a right to two hundred acres of Land as his additional claim agreeably to entry filed which is granted accordingly.

477. Alexander Stewart this day claimed a right to two hundred acres of Land as his additional claim which is granted him accordingly.

John Vaught came into Court and relinquished his certificate No. 435 which was heretofore granted him by this Court.

478. John Vaught this day claimed a right to one hundred acres of Land on Pond Creek agreeably to entry filed which is granted accordingly.

479. James Irvin this day claimed a right to two hundred acres of Land as his Additional Claim agreeably to entry filed which is granted accordingly.

480. Thomas Forker this day claimed a right to two hundred acres of Land as his additional claim agreeably to entry filed which is granted accordingly.

Matthew Ward came into Court and relinquished his Certificate No. [blank] for two hundred acres of Land which was heretofore granted him by this [Court].

481. Matthew Ward this day claimed a right to one hundred and Sixty Six acres of Land on Cypress agreeably to entry filed which is granted accordingly.

Ordered that the following hands be added to the precinct of the road from Barnabas Wings to Greenville towit Lew Dobyns, Benjamin Littlepage, David Rhoads, James Wilcox, Council Alcock, Richard N. Alcock, John Rice, Johnathan Rice, James Price, Rice Price, Barnabas Wing & his Sons & Edmond (??) assist Jeremiah Langly in opening and keeping the Same in repair as the Law directs.

Ordered that the road from Lewisburg to Greenville to Lewisburg be established as the County road leading from Greenville to Hartford and that the other roads leading from Greenville to Hartford be established fifteen feet wide only.

An Indenture of bargain and Sale between Daniel Rhoads of the one part and Stephen Hoplon [or Hoßlon or Hosslon] of the other part was acknowledged by the Said Daniel Rhoads a party thereto to be his act and Deed and ordered to be recorded.

James Weir lists the following property for taxation towit three hundred & thirty two acres of third rate Land on Jarrels Creek entered Surveyed and Patented to Said Weir, two hundred acres of Land on Bryers run entered Surveyed and Patented for Same, two hundred acres of Land on Elk Pond Creek entered Surveyed and Patented to Same.

Ordered that William Standly be and he is hereby exempt from being Overseer of the road from Greenville to Earls mill.

Ordered that Samuel Weir be and he is hereby appointed Collector of the County levy for the last year and who together with William McCommon and Charles F. Wing his Securities entered into and acknowledged their bond in the penalty of one thousand dollars Conditioned as the Law directs.

Ordered that Thomas Grayson be and he is hereby appointed Surveyor of [the] road from Greenville to Harris's branch as it leads to Littlepages ferry and that he together with the following hands towit John Earles(?) and hands, Benjamin Clark and hands, Mr. Nall, James McCaleß [McCaless or McCaleb], William Grayson and hands, William Mcadue Sr., William Mcadue Jr., Jesse Oats [Oates] & hands, William Oats [Oates], Eli Smith, William Stanly, John Grayson, Sikes Garris, Sharp Garris, William Bradford, Mrs. Campbell's hands, Michael Goodnight, Peter Goodnight, Edward Jarvis, John Jarvis, William Wilkins & Son open and keep the Same in repair Thirty feet wide as the Law directs.

Ordered that the following hands be added to the precinct of the road from Daniel Rhoades to Logan County line towit Samuel A. Grable, Daniel Rhoads, James Nanny, Abraham Avey(?), William Patton, Avery Wood, Jacob Studebaker, Samuel Penrod, Michael Ripple & Adam Billings assist Samuel Biggerstaff in opening and keeping the said road in repair as the Law directs.

Ordered that the following hands be added to the precinct of the road from Armstrongs mill to Logan County line towit Thomas Biggerstaff, Moses Etherton, George Armstrong, John Armstrong, James Armstrong, Andrew Parkes [Parks or Parker], John Wright, Stephen Write [Wright], William Thompson, John Biggerstaff, William Black, Elijah Turner and Acha(?) Warnick [Warrick?].

482. John Paul this day claimed a right to one hundred acres of Land on Pond Creek agreeably to entry filed which is granted according[ly].

483. Richard Boggus [Boggess] Junior this day claimed a right to two hundred acres of Land agreeably to entry filed which is granted accordingly.

484. Richard Boggus [Boggess] this day claimed a right to one hundred and fifty acres of Land on Isaacs creek agreeably to entry filed which is granted accordingly.

Ordered that Charles F. Wing Clerk to this Court bind unto William McCommon & his Heirs John Stone of eleven years old the 29th day of July last Son of Elizabeth Stone until he arrives to the age of twenty one years old to learn the art and trade of farming and at the expiration of his Said apprenticeship the Said McCommon is to give him two good new Suits of Cloth and a 50 dollar horse.

Ordered that Charles F. Wing clerk to this Court being to William McCommon & his Heirs Nancy Stone of two years old the 25th day of last September to Serve him and his Heirs until She arrives to the age of Sixteen years old according to Law.

The Court appointed Jesse Kerby [Kirby] Constable in and for the Town of Greenville and also for the County of Muhlenberg who thereupon took the oath to Support the Constitution of the United States, the oath of fidelity to this Commonwealth, also the oath of Constable and together with Alney McLean, William Bradford, Charles F. Wing and Christopher Tompkins his Securities entered into and acknowledged their bond in the penalty and Conditioned as the Law directs.

Ordered that William McCommons ferry on Green River be and is hereby discontinued.

Ordered that William Bradford be and he is hereby appointed commissioner of the Tax for the year one thousand eight hundred and four upon his Executing bond as the Law directs.

Ordered that Court be adjourned until Tomorrow morning at Ten of the Clock. The minutes of these proceedings were Signed. William Bradford.

Tuesday, 28 Feb 1804

Present William Bradford, Charles Lewis & Thomas Irvin - Esquires

485. John Huston by Elijah Wilson this day claimed a right to two hundred acres of Land as his additional claim on Pond Creek agreeably to entry filed which is granted accordingly.

William Bradford who was appointed commissioner of the Tax for the ensuing year came into Court and together with Charles F. Wing his Security entered into and acknowledged their bond in the penalty and Conditioned as the Law directs.

Isaac Davis Esquire Sheriff of Muhlenberg County came into Court and together with William Bradford and Charles F. Wing his Securities entered into and acknowledged their bond in the penalty of ten thousand dollars current money Conditioned for the Collection of the Taxes for the present year which bond made in the words and figures as follows towit Know all men by these presents that we Isaac Davis, William Bradford and Charles F. Wing are held and firmly bound unto James Garrard esquire Governor of Kentucky in the penalty of ten thousand dollars Current money the payment of which well and truly to be made to the said Governor and his Successors in Office we bind ourselves our heirs &c. Jointly and Severally firmly by these presents Sealed with our Seals and dated this 28th day of February 1804.
The Condition of the above Obligation is Such that if the above bound Isaac Davis Sheriff of Muhlenberg County Shall well truly & faithfully Collect pay and account for all taxes and Interest Which is or may become due according to Law which ought to be Collected by him for the year one thousand eight hundred and three into the Treasury of this Commonwealth then the above Obligation to be void else to Remain in full force Isaac Davis (Seal) William Bradford (Seal) C.F. Wing (Seal) Executed in the presence of the Court.

At a County Court held for Muhlenberg County at the Courthouse in Greenville on Monday the 23rd day of April 1804

Present Thomas Irvin, William Garrard, Matthew Adams, Joseph Arnold & William Bradford - Esquires

William Boggus' [Boggess] Stockmark a crop and slit in the left ear and a slit and half crop in the right ear on his motion is ordered to be recorded.

James Wilkins' Stockmark a half crop in the underside of each ear on his motion is ordered to be recorded.

William Wilkins' Stockmark a Swallow fork in the left ear and a smooth crop in the right on his motion is ordered to be recorded.

Elisha Uzzell's Stockmark an under Slope and over bit in each ear on his motion is ordered to be recorded.

David Rhoads' Stockmark a crop off the right ear and under bit in the left on his motion is ordered to be recorded.

Joseph Garris's Stockmark a crop and underbit in the right and a Swallow fork and underbit in the left ear on his motion is ordered to be recorded.

The Last will and Testament of Frederick Severs deceased was produced to Court and proved by the Oaths of Henry Rhoads Senior and Abraham Unsell two of the Subscribing Witnesses thereto and ordered to be recorded and on the motion of Solomon Rhoads and Jesse Jackson the executors therein named who made oath as the Law directs Certificate is granted them for obtaining a probate thereon in due form of Law upon their entering into bond and Security agreeably to Law and who thereupon together with Henry Rhoads & Matthew Adams their Securities entered into and acknowledged their bond in the penalty of three hundred dollars Conditioned as the Law directs.

Ordered that Henry Rhoads Senr., William Smith, Frederick Unsill and Abraham Uncel or any three of them (being first Sworn) do appraise in Current money the personal estate and Slaves (if any) of Frederick Severs deceased and that the Executors return an Inventory thereof to this Court.

Michael Severs Junr. orphan of Frederick Severs deceased came into Court and made Choice of Frederick Unsell for his guardian who together with James Smith his Security entered into and acknowledged their bond for Securing the Said orphans Estate.

Gabriel Severs orphan of Frederick Severs deceased came into Court and made Choice of Jacob Severs for his guardian and the Court doth appoint Said Jacob Severs guardian to Gabriel Severs orphan of Frederick Severs deceased who together with Alney McLean his Security entered into and acknowledged their Bond as the Law directs for Securing the Said orphans Estate.

Elizabeth Stone came into Court and by her consent It is ordered that the Clerk bind to David Casebier Delila Stone daughter of the Said Elizabeth Stone She the Said Delila being Seven years old the twelfth day of March last as the Law directs.

Ordered that David Thomas be and he is hereby appointed Surveyor of the road from Greenville to Lewisburg in the room and place of John Cain who is exempt and that he together with the hands heretofore allotted to Said Cain open and keep the Same in repair as the Law directs.

486. John Gather this day claimed a right to two hundred acres of Land agreeably to entry filed which is granted accordingly.

487. James Welborn this day claimed a right to four hundred acres of Land agreeably to entry filed which is granted accordingly.

Ordered that John Culbertson, Thomas Irvin and Lewis Kincheloe be and they are hereby appointed Commissioners to Settle with the Executors of Richard Tyler deceased and make report thereof to the next Court as the Law directs.

William Jinny this day came into Court and relinquished his Certificate No. 547 which was heretofore granted him by this Court.

489. Peter Jones this day claimed a right to four hundred acres of Land agreeably to entry filed which is granted accordingly.

490. John Laws this day claimed a right to two hundred acres of Land agreeably to entry filed on Pond River which is granted accordingly.

Amos Ash came into Court and relinquished two hundred and twelve acres of Land a part of his Certificate No. 263 which was heretofore granted him by this Court.

491. Abraham Billings this day claimed a right to two hundred and Twelve acres of Land on Clifty agreeably to entry filed which is granted accordingly.

492. Elisha Langley this day claimed a right to two hundred and Sixty acres of Land on Jarrels Creek agreeably to entry filed which is granted accordingly.

493. Martin Roark this day claimed a right to one hundred and Eight five acres of Land on Cany agreeably to entry filed which is granted accordingly.

501. John Shutt [or Shull?] this day claimed a right to four hundred acres of Land on Green River agreeably to entry filed which is granted accordingly.

502. Warren Boggus [Boggess] this day claimed a right to one hundred and fifty Two acres of Land on Pond Creek agreeably to entry filed which is granted accordingly.

503. Robert Wilkins this day claimed a right to four hundred acres of Land on the Waters of Pond River agreeably to entry filed which is granted accordingly.

504. John Beard this day claimed a right to two hundred acres of Land on Beech Creek agreeably to entry filed which is granted accordingly.

John Hopkins came into Court and resigned as Constable.

Ordered that the Tavern rates in this County be continued as last fixed.

Ordered that the Treasurer of the bord of Trustees of the Town of Greenville pay Christopher Tompkins Esquire Seventy dollars out of the money arrising from the Sales of the Lots in Said Town agreeably to an order from the Honorable the Circuit Court for his Services as Commonwealths attorney for the Muhlenberg Circuit Court which is ordered to be Certified accordingly.

An Indenture of bargain and Sale between Charles F. Wing attorney in fact for Martin Cutsinger of the one part and Frederick Phillip of the other part was acknowledged by the Said Charles F. Wing attorney as aforesaid to be his act and Deed and ordered to be recorded.

Ordered that Edward Jarvis, Andrew Worthington and Benjamin Worthington (who being first sworn) do view and mark out the best and most Convenient way for a road from John Bryants to the Island fork on Pond River and make report thereof as the Law directs to this Court.

David Casebier came into Court and resigned as Constable.

On the motion of James McCartney leave is granted him to remove his Certificate heretofore granted him by this Court.

Ordered that the following hands be added to the precinct of the road from Greenville to Lewisburg towit Peter Goodnight, Thomas Barfield, William Wilkins an[d] his hands, Michael Goodnight, Jacob Wiley and William Tanner and that they assist on opening and keeping the Same in repair.

The persons appointed for that purpose made the following report towit Agreeably to an order to us directed we have viewed a road from Lewisberg to intersect the Loagn road passing Through the Land of Elias Kincheloe, Lewis Kincheloe & Isaac Davis by consent through James Tinsleys who forbids the road and through the Land of Jesse Davis and Cornelius Davis to the Cliff on Pond Creek then near Evans's line on a dry ridge to the land of Edward Williams and through the land of Gilbert Vaught and Fultons then a direct Course to intersect the Logan road at the Lick on Jacobs Creek April 13th 1804 Isaac Davis, Gilbert Vaught, John Vaught viewers and It appearing to the Satisfaction of the Court they are of opinion that the Same be altogether quashed.

On the motion of James Ivans for a writ in the nature of Adquadamnum for the purpose of building a water Gristmill on Pond Creek he owning the Lands on both Sides thereof It is ordered that the Sheriff Summons a Jury of the vicinity aforesaid to meet on the 28th day of this Instant at the place aforesaid and view and examine the Same above and below and report thereof to the Court as the Law directs.

On the motion of Samuel Weir Security for Elias Smith as Executor to the Estate Last will and Testament of John Smith deceased It is ordered that a Summons issue against the Said Smith to appear here at the next Court and give counter Security.
