Muhlenberg County Court Order Book 5, Page 1 - April Term 1842

At a county court began & held for Muhlenberg County at the courthouse in Greenville on Monday the 25th day of April 1842. Present Strother Jones, John Campbell, Solomon Rhoads, J.H. Lindley, Saml. M. Wilkins.

Settlement made with Elizabeth Oates guardian to James & Jesse R. Oates was exhibited in to court and ordered to lie over.

Same with the administrator of John Smith decd. Same order.

Same with the administrator of S.A. Grable decd. Same order.

Same with the executor of Albritton Drake decd. Ordered to lie over.

[copied] Thomas L. Martin commissioner of the tax in the upper battalion exhibited in to court his book as such which being examined & approved of is received. Ordered that said commissioner be allowed at the rate of eight cents per list for six hundred & fifity lists. Returned by him under the late law. Which is ordered to be certified to the auditor of public accounts.

Ordered that summons issue against Isaac Bard, William McLean, I.A. Clifford & O.C. Vanlandingham. Reported by the commissioner as having failed to give a list of their taxable property.

The commissioner appointed for that purpose returned in to court their report setting apart to Mrs. Feruba Harper, widow of Nathan Harper deceased, her dower in & to the lands & estate which was approved of & received by the court. [Image]

The court, a majority being present, appointed Alexander Campbell constable in the district & in the room of G.K. Nall whose time had expired, who thereupon took the several oaths prescribed by law & together…

Muhlenberg County Court Order Book 5, Page 2 - April Term 1842

…with P.L. Townes & Ephraim S. Baker, his security, executed bond in the penalty & condition as the law directs.

The court appointed Thomas L. Martin constable in the district in which he formerly acted, who thereupon took the several oaths prescribed by law & together with C.C. Martin, John S. Eaves & James W. Rice, his security, executed bond in the penalty & condition as the law directs.

Present J.W. Poag & Charles Tyler Esqrs.

The commissioners appointed for that purposed reported that they had viewed the proposed alteration of the road leading from Hoggs falls to Millport which report was received & said alteration established.

On the motion of Merit Lyan, ordered that Alney M. Tolbert, Robert Welborn & Oliver V. Tolbert be appointed commissioners to view & mark out an alteration of that part of the raod leading from Greenville to Bowling Green as the same passes the farm of said Lyan & make report thereof as the law directs.

On the motion of Samuel Grable who made oath as the law directs, certificate is granted him for obtaining letters of administration on the estate of Christopher Grable deceased, who thereupon took the oath prescribed by law and together with Isaac Newman, Robert Jenkins & Thomas Whitaker, his security, executed bond in the penalty of $1500 conditioned as the law directs.

The court appointed Jesse R. Oates constable in the district in which Isaac Woods formerly acted, who thereupon took the several oaths prescribed by law & together with Bailes E. Oates, Thomas Morgan & John S. Eaves, his security, executed bond in the penalty of $2000 conditioned as the law directs.

[fee paid] The court appointed John Stroud constable in & for the town of Rumsey, who thereupon took the several oaths prescribed by law & together with John Baxter & John Stroud Sr., his security, executed bond in the penalty of & condition as the law directs.

Muhlenberg County Court Order Book 5, Page 4 - April Term 1842

In the case of the county of Muhlenberg against Solomon Rhoads late sheriff on a notice & which case has this day been continued, the following justices (being a majority at the time on the bench) voted for the continuance of said case towit David T. Short, John Campbell, Wm. M. Moore, S.M. Wilkins, William Martin, Strother Jones & J.H. Lindley.

On the motion of Robert Williams it is ordered that Robert Williams, Jacob Vick & Samuel Eades be appointed to view & mark out the best & most convenient way for a road to lead from Zelpha Oates's to Thomas Barfield passing Robert Williams' & Jacob Vick's farms & make report &c.

Ordered that James W. Rice & Moses Rice, S.M.J. Duvall, Mourning Hunt, Preston Wells, Goleman Wells & Wm. Douglass be added to the precinct of the road whereof Gideon Edwards is surveyor.

Ordered that Benjamin Linton & James Adcock be released from paying county levy in furture owing to their age & infirmity. [Image]

A power of attorney from the heirs of Arington Wickliffe decd. to Willis Dearing was exhibited in to court & acknowledged by J.B. Oates, David Oates, B.J. Wickliffe, Jno. D. Wickliffe, John M. Oates, Elizabeth Oates, William B. Wickliffe & Lewis K. Barfield parties thereto to be their act & deed, which is ordered to be certified. [Image]

Inventory & appraisement of the estate of Larry Stringer deceased was returned in to court by the administrator & ordered to be recorded.

Ordered that Jackson Turner & all the hands within the bounds running from L. Boggess place to Polly Turner's thence to J. Langley's & to Charles Metzker's be added to the precinct of the raod whereof Berry Turner is surveyor.

Ordered that Joseph Adcock be appointed surveyor of that part of the road leading from Greenville to Morgantown whereof Samuel M. Ross was surveyor & that he with the hands formerly allotted together with Samuel Jackson & hands, John Smith, Joseph Adcock, Alney Unsell & Peter Smith, Lemuel Ricket, S.M. Ross, Samuel Griffith, Lewis Griffith & James Griffith open & keep the same in repair, 30 feet wide as the law directs.

Ordered that Thomas Drake be appointed surveyor of that part of the road whereof Joseph Noftsinger was surveyor & that he with the hands formerly allotted open & keep the same in repair, 15 feet wide as the law directs.

Ordered that Nathaniel Howard be appointed surveyor of that part of the road leading to Hustons ferry whereof Edmund Batsel was surveyor & that he with the hands formerly alloted, open & keep the same in reapir, 15 feet wide as the law directs.

Ordered that Henry Morehead be appointed surveyor of that part of the road leading from Greenville to Rumsey whereof Sampson Bethel was surveyor and that he with the hands formerly alloted open & keep the same in repair, 15 feet wide as the law directs.

Ordered that Thomas J. Anthony Captain, John Stokes, James Thompson & James Mannahan be appointed patrollers in the bounds of the Greenville militia company who are to serve as the law directs.

Ordered that William Tuder be appointed surveyor of that part of the road leading from Greenville to Madisonville whereof Henry Williams was surveyor & that he with the hands formerly allotted open & keep the same in reapir, 30 feet wide as the law directs.

Ordered that Frederick Unsell be appointed surveyor of that part of the road leading from Greenville to Morgantown whereof L.A. Puckett was surveyor & that he with the hands formerly alloted open & keep the same in repair, 30 feet wide as the law directs.

Ordered that Samuel Vanlandingham be appointed surveyor of that part of the road leading from Skilesville to Lewisberg whereof Reuben Arnold was surveyor & that he with the hands formerly allotted open & keep the same in repair, 15 feet wide as the law directs.

Ordered that Jacob Imbler be appointed surveyor of that part of the road leading from Greenville to Greens mill whereof William Green was surveyor & that he with the hands formerly allotted open & keep the same in repair, 15 feet wide as the law directs.

Ordered that William Cundiff be appointed surveyor of that part of the road whereof Andrew Glenn Jr. was surveyor & that he with the hands formerly allotted open & keep the same in repair, 15 feet wide as the law directs.

Israel J. Baker Esqr. produced a commission from his excellency the Governor bearing date the 26 day of July 1841 appointing him a justice of the peace in & for this county with a certificate thereon of his having taken the several oaths prescribed by law.

Ordered that William Eaves Jr. be appointed surveyor of that part of the road leading from Greenville to Lewisberg that lies between E.M. Brank's & the Bald Hill & that he with the hands in the following bounds Beginning at E.M. Branks thence to include Thos. Eaves, Jacob Anthony, Thomas Anthony thence to include John Goodnight, open & keep the same in repair, 30 feet wide as the law directs.

Muhlenberg County Court Order Book 5, Page 7 - April Term 1842

Ordered that Gedeliah Hughes be appointed surveyor of that part of the road leading from the Bald Hill to Charles Morehead's lane & that he with the hands in the following bounds Beginning at the Bald Hill thence to include the following hands [blank].

Ordered that Jacob Vick be released as guardian for Albert Mercer he having executed bond as such at a previous court.

Ordered that Ephraim M. Brank, county treasurer, pay in to the hands of Bennet D. Bailey Esqr., when called for, one hundred dollars for the purpose of building a bridge across Nelsons Creek on the road leading from Lewisberg to Skilesville & that B.D. Bailey, Benjamin S. Young and Peter James W. Poag be appointed commissioners to select a date[?] & let the building of said bridge.

Ordered that E.M. Brank, county treasurer, pay in to the hands of Moses Wickliffe fifty dollars when called on for the purpose of repairing the bridge across Pond Creek called Small Bridge & that said Wickliffe let said repairs & make report thereof.

[copied] Ordered that E.M. Brank, county treasurer, pay in to the hands of Sovereign Hollowell, John Noftsinger & C. Tyler or either of them ninety five dollars for repairing the bridge across Cypress Swamp on the road from Carrolton to Madisonville near Randolph's old bridge & that said persons let the said repair & make report thereof.

[copied] Ordered that E.M. Brank, treasurer, pay in to the hands of John Bland, J.W.I. Godman & William Kincheloe or either of tehm one hundred dollars for the purpose of improving that part of the road leading from Skilesville to Rumsey by the way of William Kincheloe's, running through the throughfare & that they let the repairs or improvements necessary & make report therefore.

Muhlenberg County Court Order Book 5, Page 8 - April Term 1842

[copied] Ordered that E.M. Brank, treasurer for the county, pay in to the hands of John Vickers & Elisha Baker or either of them one hundred dollars for the improvement of that part of the road leading from Greenville to Rumsey that lies between Vickers Bridge & Rumsey & that they let said improvements & make report thereof.

[copied] Ordered that E.M. Brank, treasurer, pay in to the hands of William M. Moore & William Nall or either of them seventy dollars for the improvement of that part of the road leading from Rumsey to Madisonville that lies between Rumsey & Nalls Bridge & that they superintend [sic] & let said improvement & make report thereof.

Ordered that E.M. Brank, county treasurer, pay into the hands of Strother Jones, Ezekiel Rice & William Hancock or either of them seventy dollars for the improvement of that part of the road leading to Hopkinsville that lies between the Cave Spring & Pond River Bridge & that they let the necessary improvement and make report thereof.

Ordered that E.M. Brank, county treasurer, pay in to the hands of Moses Wickliffe, Benj. Casebier, & Robert Wickliffe or either of them fifty dollars for the repairing Heltsleys Bridge across Pond Creek & that they let said repairs & make report thereof.

Ordered that Barnabas Rhoads be appointed surveyor of that part of the road whereof Moses Glenn was formerly surveryor & that the with the hands formerly allotted open & keep the same in repair, 15 feet wide as the law directs.

Ordered that Eli McPherson be appointed surveyor of that part of the road leading from Greenville to Russellville whereof Lewis McPherson was surveyor & that he with the hands formerly allotted open & keep the same in repair, 30 feet wide as the law directs.

Ordered that Michael Whitmer be appointed surveyor of that part of the road leading from Nicholls Cross Road whereof Samuel O. Grundy was surveyor and that he with the hands formerly allotted open…

Ordered that James[?] M. Bell be appointed surveyor of that part of the road leading to Russellville whereof Thomas Newman was surveyor & that he with the hands formerly allotted open & keep the same in repair, 30 feet wides as the law directs.

Ordered that Jesse Welch be appointed surveyor of that part of the road leading from Greenville to Rumsey that whereof Joseph Hendricks was surveyor & that he with the hands formerly allotted open & keep the same in repair, 30 feet wides as the law directs.

Ordered that Thomas Cundiff be appointed surveyor of that part of the road leading to Martins ferry whereof James Rose was surveyor & that he with the hands formerly allotted open & keep the same in repair, 15 feet wide as the law directs.

Muhlenberg County Court Order Book 5, Page 10 - April & May Terms 1842

…with [sic] James Rothrock, Jno. Campbell, A.H. Lovelace, E.M. Brank & the hands at the Stemerys open & keep the same in repair, 30 feet wide as the law directs.

Ordered that Oliver Kimley be appointed surveyor of that part of the road lying between Heltsleys bridge & Williams ferry whereof E.V. Kirtley was surveyor & that he with the hands in the following bounds Beginning at the ferry thence up the river to Jacobs Creek, thence to the Ridge Road, thence to F. Kimley's excluding him thence with the road from Heltlseys to said ferry open & keep the same in repair, 15 feet wide as the law directs.

Ordered that the court be adjourned until court in course.

A settlement with the executor of Albritton Drake deceased was exhibited in to court & having laid over one term is ordered to be recorded.

Same with the guardian of James & Jesse R. Oates, orphans of William Oates deceased was again returned in to court & ordered to be recorded.

Same with the administrator of Samuel A. Grable was again returned in to court & ordered to be recorded.

Same with the administrator of John Smith deceased was again returned in to court & ordered to be recorded.

Settlement with the administrator of Nathan Harper deceased was returned in to court & ordered to lie over till next term.

Muhlenberg County Court Order Book 5, Page 11 - May Term 1842

A settlement with the executor of Isaiah Hancock deceased was exhibited in to court & ordered to lie over till next court.

Gilbert Clark exhibited in to court his list of taxable property for the year 1842 (see list) which being sworn to, examined & allowed is ordered to be certified to the audiotr of public accounts and the sheriff of this county.

Ordered that Bradford Noftsinger, Joseph Noftsinger, Zachariah Stroud, Jacob Gossett, Daniel Gossett & Jacob Gish be added to the precinct of the road leading from Lewsiberg to Rumsey whereof Thomas Drake is overseer.

[paid by M.F. Glenn] Moses F. Glenn agent for O.C. Vandlandingham exhibited in to court his list of taxable property (see list) which being examined & sworn to is ordered to be certified to the auditor of public accounts & the sheriff of this county.

Ordered that John Campbell, Charles F. Wing & Robert S. Russell be appointed commissioners to examine the public well in this place & if in their opinion the old well will afford sufficient water for the use of the town that they have the same cleared out & make such repairs as may be necessary about said well but if said well should not afford sufficient water, that they examine the ground & fix upon some suitable date[?] for digging a new well & that they report the probably costs to the court forthwith.

Ordered that Silas Taylor, Jarred Wallace & Gedeliah Hughes be appointed commissioners to view & examine an alteration of that part of the road leading to Rumsey as the same passes the farm of Sovereign Hollowell & make report as the law directs.

Charles F. Wing, clerk to this court, exhibited in to court his account against the Commonwealth for record books amounting to $39.50 which being sworn to, examined & allowed is ordered to be certified to the auditor of public accounts.

Muhlenberg County Court Order Book 5, Page 12 - May Term 1842

The persons appointed for that purpose reported that they had examined that part of the road leading from Greenville to Bowling Green as it passes the farm of Merit Lyan, which report was received by the court.

The commissioners appointed to view & mark out an alteration of that part of the road leading from Greenville to Rumsey where the same passes the farm of Sovereign Hollowell returned in to court their report, which being examined & approved of is ordered to be recorded & that said alteration be established upon the said Hollowell opening the same as the law directs.

On the motion of John Bland who made oath as the law directs, certificate is granted him for obtaining letters of administration on the estate of Fildred Hollomon deceased who thereupon together with Felix Nall & Jared Wallace, his security, executed bond in the penalty of $300 conditioned as the law directs. Ordered that David Peregrin, S.W. Drake, Richard Webb & William Morehead or any three of them being first sworn appraise in current money the personal estate of said Hollomon & make report thereof.

On the motion of Charles W. Murphy who made oath as the law directs, certificate is granted him for obtaining letters of administration on the estate of Zilpha Ann Murphy deceased, whereupon said Murphy together with Peter Boggess [possibly crossed out], Ephraim Durell, William Robinson and William G. Jones, his security, executed bond in the penalty of $3000 conditioned as the law directs.

Ordered that the bounds of the district in which Lewis Reno acts as constable be so altered as to include the farm of Charles Morehead.

Power of attorney from A. Wickliffe heirs to Willis Deering was exhibited in to court & proved to be the act and deed of Susan Wickliffe, a party thereto, by the oaths of Timothy Umphrey & William Wickliffe subscribing witnesses, which is ordered to be certified. [Image]

On the motion of Wm. B. Wickliffe, Moses Wickliffe & Timothy Umphrey came in to court & the court being satisfied that they are creditable persons, said Wickliffe & Umphrey made oath that J.B. Oates late Wickliffe who imtermarried with David Oates, Benjamin Wickliffe, John D. Wickliffe, Elizabeth Oates late Wickliffe who intermarried with John M. Oates, William B. Wickliffe, Lewis K. Barfield who intermarried with Angeline Wickliffe deceased, & Susannah Wickliffe are the heirs and legal representatives of Arington Wickliffe decd. of Revolutionary memory, which is ordered to be certified. Thomas Newman & James Newman, orphans of Jacob Newman deceased, came in to court & made choice of I.J. Baker their guardian who thereupon together with Peter H. Baker & B.E. Pittman, his security, executed bond in the penalty of $500 conditioned as the law directs. [Image]

The court appointed said I.J. Baker guardian to William G. Newman, orphan of Jacob Newman deceased, who thereupon took the oath & together with Peter H. Baker & B.E. Pittman, his security, executed bond in the penalty of $250 conditioned as the law directs. [Image]

The commissioners appointed for that purpose reported that they had examined the public well of this place & the repairs necessary to be done &c. which was received. It is thereupon ordered that said commissioners superinted [sic] the opening & cleaning out said well, having due regard to economy in performing said work & make report thereof.

On the motion of Samuel Gossett who is desirous of creating a water grist mill on Cypress Creek, he owning the land on both sides of the creek, it is ordered that a writ of Adquod damnum be awarded him directed to the sheriff of this county, requiring him to summons & impanel a jury of this vicinage to meet on the premises & view & examine the ground both above & below the place proposed for the dam & report what damage if any will accrue to the meighbourhood by reason of building the dam (aforesaid) that said jury meet for th purpose aforesaid on the 3rd day of June 1842 & make report.

William Tuder surveyor of that part of the road leading from Greenville to Madisonville bying with the following bounds: Beginnig at the north end of E.M. Brank's; lane thence to include John Roark, thence to include Hugh H. Martin, thence to William Tuder's including him, thence to Juble Vincent's including him thence to Charles Vincent's including him, thence to John Vincent's including him, thence to James Roark's including him, then to Stephen Vick including him, thence to William Adkins including him, thence to include Dr. R.D. McLean's farm thence to the Beginning with all the hands in the bounds, 30 feet wide.

This day came as well the attorney for the Commonwealth as the defendant in his own proper person, wherefor on motion of the attorney for the Commonwealth, it is considered by the court that the plaintiff recover of the said defendant four hundred & fifty four dollars & fifty cents, the debt in the notice set out and also their costs by them in this behalf expended & the said defendant in mercy &c.

Ordered that Charles F. Wing, clerk to this court, procure a suitable press to be kept in his office in which to put the books lately donated the county by Edward Rumsey Esqr. and that B.E. Pittman pay said Wing out of any money in his hands belonging to the county the price of said press. [Image]

Muhlenberg County Court Order Book 5, Page 16 - May & July Terms 1842

B.S. Young commissioner of the tax for the year 1842 in the lower battalion returned to court his book which being examined was received by the court. Ordered that said Young be allowed the sum of fifty seven dollars & 60 cents for 720 lists at 8 cents per list with a deduction therefrom of $11.52 cents the 20 percentum thereon as the law directs which is ordered to be certified.

Ordered that a summons issue against William A. Page returnable here at the next court for failing to list his taxable property.

Ordered that the court be adjourned until court in course.

A writ of Adquod damnum granted by this court to Samuel Gossett was returned by the sheriff together with the inquest of the jury taken thereon, which being examined by the court, on motion of said Gossett, it is ordered that the mill seat therein named be and the same is hereby condemned agreeably to the inquest of the jury aforesaid.

On the motion of William D. Lindsey (a majority of the court being present & concurring) who made oath as the law directs, the court appointed him constable in & for the town of Greenville in place of said Young, who thereupon together with A. Lindsay, Barnet Eades, Azariah Doss & A.H. Lovelace, his security, executed bond in the penalty & condition as the law directs.

On the motion of Thomas Terry who made oath as the law directs, certificate is granted him for obtaining letters of administration on the estate of Young Lovelace deceased, who thereupon together with A.H. Lovelace, James Rothrock & William W. Martin, his security, executed bond in the penalty of $1200 conditioned as the law directs. Ordered that William Martin & Thomas Martin, Barnet Eades, Samuel Wilkins or any three of them being first sworn, appraise in current money the personal estate & slaves if any of afsd. decedent & that the admr. make report thereof.

James H. Lindsley Esqr. came in to court and resigned as a justice of the peace for said county. Ordered that the books & papers of said Lindsey [sic] be delivered to C.M. Baker Esqr.

[fee paid] The court appointed James H. Rust constable in the district in which James F. Moore formerly acted who has this day resigned. Whereupon said Rust took the oath against dueling, who together with Jacob Anthony, Charles D. Ward and Elisha Baker, his secutiry, executed bond in the penalty & condition as the law directs.

On the motion of G.C. Vaught surveyor of the part of the road lying between Small Bridge & Vaughts Mill, it is ordered that the following precinct for said road be established towit: Beginning at the mouth of Dannels Run, thence up the same to Kimley's old place including it, thence a straight line to Mrs. Hundley's including her, thence to the mill including it, thence up Pond Creek to the Beginning & that he open & keep the same in repair, 15 feet wide as the law directs.

On the motion of Peter N. Johnson (who made oath as the law directs) certificate is granted him for obtaining letters of administration on the estate of John Johnson deceased, who thereupon together with William Nall & Isaac Johnson, his security, executed bond in the penalty of twenty five hundred dollars conditioned as the law directs. Ordered that Peter Shaver, Benjamin Coffman Jr., Daniel Plain & David Evans or any three of them being first sworn, appraise in current money the personal estate & slaves of said decedent & make report thereof as the law directs.

A majority of the court being present & concurring therein, recommend to his excellency the Governor, Ephraim S. Baker & John G. Gooch as proper persons one of whom to be commissioned a justice of the peace for the town of Rumsey in place of J.H. Lindsley resigned this day.

Muhlenberg County Court Order Book 5, Page 20 - July Term 1842

The persons appointed for the purpose of viewing & marking a road to lead from Mrs. Zilpha Oates's to Lewisberg exhibited in to cour their report which being examined & approved of said road is ordered to be established. Ordered that Jacob Vick be appointed surveyor thereof to the lower Madisonville Road & that he with the hands living within four miles of said road on each side thereof open the same 15 feet wide as the law directs. And that Nathan Eades open the said road from the lower Madisonville Road to the intersection of the Lewisberg Road at Sameul Gossett's & that all the hands living within four miles on each side of said road assist in opening the same 15 feet wide as the law directs.

Charles D. Ward, security for Joseph Etherton & wife, filed his notice against said Etherton & wife requiring them to give additional security and said Etherton being in court & failing to give security as requried as guardian to Joseph E. Ellis. Whereupon the court appointed Sanders Eaves guardian to Joseph E. Ellis, orphan of Hardin Ellis deceased, who thereupon took the oath prescribed by law & together with John S Eaves Jr., his security, executed bond in the penalty of $300 conditioned as the law directs.

On the motion of Richard Tidings, it is ordered that Isaac Branscomb, John Curtis, Thomas Morgan & Benjamin Jagoe be appointed commissioners to view & mark out the best & most convenient way for a road to lead from Tidingsville formerly Millport to the Madisonville Road near Robert Branscomb's & make report thereof.

Ordered that Gedeliah Hughes by appointed surveyor of that part of the road leading to Lewisberg from Greenville that lies between the Bald Hill and the creek at Charles Morehead's & that he with the hands formerly alloted to Ephraim Durell open & keep the same in repair, 30 feet wide as the law directs.

On the motion of Hiram Lucket one of the securities of William Robinson admr. of D.W. Baird deceased, who is anxious to be released from his securityship, and the same Robinson being in court offered Samuel D. Chatham & Charles W. Murphy as counter security who thereupon executed bond in the penalty of $3000 & condition as the law directs.

On the motion of William Martin Esqr. ordered that Charles C. Summers, Thomas Morgan, John S. Eaves & Isaac Wood or any three of them being first sworn, view & mark out the best & most convenience way for a road to lead from Clarks ferry on Pond River to the intersection of the Rumsey Road between Tidingsville & D. Short's & make report thereof as the law directs.

The court proceeded to appoint judges & clerks to the ensuing elections for the present year as follows: At Greenville, Moses Wickliffe & Wm. Martin Judges & W.H.C. Wing Clerk. At Rumsey, Wm. M. Moore & John Bland Judges & Sander Eaves Clerk. At Skilesville, Solomon Rhoads & I.J. Baker Judges & Samuel Rhoads Clerk.

Charles F. Wing, clerk to this court, exhibited his account against the Commonwealth for one press amounting to $15 which is ordered to be certified to the auditor of public accounts.

Ordered that the commissioners heretofore appointed to superintend the digging the public well in this place proceed to have the same completed with as little expense as they can & that they be authorised to draw orders on B.E. Pittman, county attorney, for the same out of the judgment & rendered against Solomon Rhoads late sheriff by this court & ordered to be paid said Pittman.

On the motion of John Vickers who is desirous of creating a water sam mill on Cypress Cyreek near his residence, he owning the land on both sides thereof, it is ordered that a write of adquad damnum be awarded him directed to the sheriff of this county, requiring him to summon & impanel a jury of the vicinage to meet on the premises on the sixth day of September next & examine the premises both above & below the place proposed for the dam & report what damages if any will accrue to the neighborhood & make report thereof.

Muhlenberg County Court Order Book 5, Page 23 - August Term 1842

Ephraim M. Brank, the executor named in the last will & testament of Jacob Anthony deceased, came in to court & having taken the oath prescribed by law, certificate is granted him for obtaining a probate thereon, who thereupon together with Robert Wickliffe, Edward Rumsey & George W. Short, his security, executed bond in the penalty of sixteen thousand dollars conditioned as the law directs.

Ordered that James T. Quissenbury [Quisenberry], Ephraim Durall Moses Wickliffe, Charles Morehead & Wiley S. Hay or any three of them being first sworn appraise in current money the personal estate & slaves if any of said decedent & that the admr. return an inventory thereof as the law directs.

Ephraim S. Baker Esqr. produced a commission from the Governor appointing him a justice of the peace in & for said county bearing date the 1st day of August 1842 with a certification thereon of his having taken the oaths prescribed by law.

Glenn one of the heirs of said decedent, John Baxter and Moses Wickliffe Esqr., creditable witnesses, came in to court & made oath that Nancy Glenn, Sally Glenn, Ditzey[?] Ferguson late Glenn, Susanna B. On the motion of Enos West, it is ordered that John Thomas Kilgore, orphan of Eliza Kilgore deceased, be bound to the said West until he arrives to the age of twenty one years of age to learn the art & trade of a farmer, he the said Thomas being four years of age on the 22nd day of August 1842, and it is further ordered that the said West enter into an indenture for that purpose with the clerk of this court as the law requires. Order that Jefferson Martin be appointed overseer of the 2nd precinct lying between the end of the 1st precinct & the mouth of James Irvin's lane & that he with the hands in the following bounds: Beginning at Hugh W. McNary's including him & the hands under him as overseer, thence down the river including E.K. Dillingham & the hands under him as overseer, thence with the Madisonville Road to where the same crosses said road thence to the Beginning, open the same 15 feet wide as the law directs. The 3rd precinct commencing at the mouth of Irvin's lane & running to Millport. Whereupon said viewers reported that they had viewed & marked out said alteration which report was received & said alteration established accordingly.

The Commonwealth against William A. Page for not listing his taxable property. Ordered that this suit be dismissed at the costs of the defendant (see list filed by Jno. Bland).

Inventory & sale bill of Jacob Anthony deceased was exhibited in to court by the executor thereof & ordered to be recorded.

The commissioner Moses Wickliffe, appointed to let the repairs to be done on Smalls Bridge across Pond Creek, reported that he had let the same for the sum of $43 & that he had paid the sum of $7 - making $50, that said repairs had been made & the bridge received, which report is ordered to be filed.

On the motion of Robert Welborn, who made oath as the law requires, certificate is granted him for obtaining letters of administration on the estate of Elizabeth Welborn deceased who thereupon together with Henry Myers & James Taggart, his security, executed bond in the penalty of $2500 conditioned as the law directs.

Ordered that I.J. Baker, W.M. Blackwell, Wilson Hartis & John B. Smith or any three of them being first sworn appraise in current money the personal estate & slaves of said decedent & that the Admr. return an inventory thereof.

The commissioners appointed to let the repairs necessary to be made on the road leading from Fentress's across the Cypress Swamp to the Madisonville Road reported that they had let the same which report is ordered to be filed.

The court appointed John Bland guardian to Thomas Carter, orphan of James Carter deceased, who took the oath prescribed by law & together with B.E. Pittman, his security, executed bond in the penalty of $300 conditioned as the law directs. [Image]

John Curtis reported that he had opened that part of the road leading to Millport of which as overseer he was ordered to open.

Thomas Morgan surveyor reported that he had opened that part of the road leading to Millport ordered to be opened by this court at their last term.

[fee paid] Everet Mitchell came in to court & on his motion, a majority being present, the court appointed him constable in place of James B. Hancock who has resigned, whereupon said Mitchell took the oath prescribed by law and together with Robert Welborn, William H. Hancock & William G. Jones, his security, executed bond in the penalty & condition as the law directs.

William G. & J.M. Jones deputy sheriffs for J. Taggart sheriff returned in to court their delinquent list for the year 1842, which being examined & sworn to is ordered to be certified.

Ordered that B.S. Young commissioner be allowed ten dollars & fifty cents the 20 percentum deducted from his allowance as commissioner for the year 1842 with a deduction of one dollar returned by the sheriff for 2 tithes not listed which is ordered to be certified.

[copied] On the motion of John Stobuck the court appointed him administrator of Adam Stobuck decd. who having taken the oath prescribed by law, certificate is granted him for obtaining letters of administration on the estate of said decedent, who thereupon together with William A. Eaves & Gillis Mercer, his security, executed bond in the penalty of $400 conditioned as the law directs. Ordered that William Martin, Bailes E. Oates, Philip Bennet & Gillis Mercer or any three of them being first sworn appraise in current money the personal estate of said decedent & that the Admr. return an inventory thereof as the law directs.

At a county court began & held for Muhlenberg County at the courthouse in Greenville on Monday the 26th day of December 1842.

Present Chas. M. Baker, Chas. Tyler, D.T. Short, R.S. Russell

The Commonwealth against Charles M. Baker on a summons for failing to attend the November County Court 1842. The defendant appeared in court and offered his excuse which was sustained. It is therefore oordered that this suit be dismissed.

The Commonwealth against William M. Moore Esqr. on a summons for failing to attend the November Court 1842. The court being satisfactorily advised of the indisposition of said Moore & his inability to attend, it is ordered that this suit be dismissed.

It appearing to the satisfaction of the court that Mrs. Lucy Hunt, widow & relict of Gasham Hunt deceased, is old & infirm & that she has in her possession certain slaves who are an expense to her, it is therefore ordered that the said Lucy Hunt be exempt hereafter from paying tax on said slaves. On the motion of Esram Hendrix who made oath as the law directs, certificate is granted him for obtaining letters of administration on the estate of Benjamin Hinkle deceased, who thereupon together with George W. Short, his security, executed bond in the penalty of $300 conditioned as the law directs. Ordered that James Scott, D.W. Whitmer, J.F. Garst & Thompson Miller or any three of them being first sworn, appraise in current money the personal estate of said decedent & that the said Admr. return an inventory thereof as the law directs.

On the motion of Rolley Sullivan, who made oath as the law directs, the court appointed him guardian to Sarah Jane, Tabitha, Charles, Emily & Maranda Bodine, orphans of Cornelius Bodine decd., who thereupon together with John J. [fee paid $1.06] The last will & testament of Jesse Everly deceased was exhibited in to court by the executor therein named & proved to be the act and deed of said decedent by the oaths of John J. Plain & Alphous Everly, two of the subscribing witnesses thereto, & ordered to be recorded.

On the motion of Samuel M. Ross, who is desirous of erecting a water grist mill on Pond Creek on the road leading from Greenville to Skilesville, he owning the lands on both sides of the creek, it is therefore ordered that the sheriff of this county summon & impanel a jury of the vicinage to meet on the premises at the old mill of Peter Boggess on the second day of January next to view & examine the ground both above & below the place contemplated for the erection of the dam & that they report what obstruction it will be to fish of passage & as the law directs.

Ordered that Wesley G. Langley be appointed surveyor of that part of the road leading from Greenville to Lewisberg whereof John Stroud was surveyor & that he with the hands formerly allotted, open & keep the same in repair 30 feet wide as the law directs.

Settlement with the Admr. of John S. Young deceased was exhibited to the court & ordered to lie over.
