Muhlenberg County Court Order Book 5, Page 185 - January Term 1846

At a county court began and held for the county of Muhlenberg at the courthouse in Greenville on Monday the 26th day of January 1846.
Present Strother Jones, David T. Short, S.M. Wilkins, William Martin

The court appointed Eliza J. Smith, guardian for James S. Smith & Aaron A. Smith, orphans of Aaron A. Smith decd., who took the oath prescribed by law & togethre with R.H. Simmons, John B. Smith & R. Pool, her security, executed bond in the penalty of $200 conditioned as the law directs. [Image]

A settlement made with Raughley Sullivan, Administrator of Cornelius Bodine deceased, was again returned to court, and having laid over one term as the law requires, is now ordered to be recorded.

A settlement with J.N. Luce, Admr. of William Luce deceased, was exhibited in to court & being examined by the court, is ordered to lie over until the next term of this court.

Ordered that Greenbury Roll be appointed overseer of that part of the road leading from Small's bridge on Pond Creek to Skilesville that lies between said bridge & Jacobs Creek whereof Barnabas W. Rhoads was oversser & that he with the hands formerly allotted open & keep the same in repair 15 feet wide as the law directs.

Muhlenberg County Court Order Book 5, Page 186 - January Term 1846

On the motion of George W. Short, David T. Short and Joseph P. Short (the widow by her writing hereto the court shown & roven & ordered to record), who made oath as the law directs, certificate is granted them for obtaining letters of Administration on the estate of David Short deceased, who thereupon together with William T. Short & Jonathan Short, their security, executed bond in the penalty of twenty five thousand dollars conditioned as the law directs.

Ordered that James H. Scott, Peter Shaver, Esram Hendricks & William D. Dempsey, or any three of them being first sworn, be and they are hereby appointed appraisers to appraise in current money the personal estate and slaves of David Short deceased, and that the Administrators return an inventory thereof as the law directs.

Mary Ann Tinkle, widow & relict of Christopher Tinkle deceased, came into court & declined taking upon herself the burden of administration of the estate of her deceased husband, and requested that the same may be granted to her brother William R. Welch, whereupon the court appointed William R. Welch Administrator aforesaid, who there having taken the oath prescribed by law, certificate is granted him of obtaining letters of administration on the estate of said decedent, who togheter with Ezekiel Fleming & John Vickers, his security, executed bond in the penalty of two thousand dollars conditioned as the law directs. Ordered that Samuel Danner, David Gish, Jacob Whitmer & Jacob Jago, or any three of them being first sworn, appraise in current money the personal estate of Christopher Tinkle deceased and that the Administrator return an inventory thereof as the law directs. On the motion of David Gish who produced in court a bond from Christopher Tinkle to said Gish for the convenyance of one hundred & fifty five acres of land & which bond was proven to be the act & deed of said Tinkle by the oath of Thomas Morgan & ordered to be recorded. Whereupon Mary Ann Tinkle proved to the satisfaction of the court that the said David Gish had paid…

Muhlenberg County Court Order Book 5, Page 187 - January Term 1846

…the purchase money for the land in the bond mentioned. On the further motion of David Gish, it is ordered that Peter Shaver, Samuel Danner, James H. Scott & David T. Short be appointed commissioners to convey to said Gish the land in the said bond mentioned and make report to the next court.

The last will and testament of Lewis Reno deceased was exhibited in to court and proved to be the act & deed of the said Reno by the oaths of Alfred M. Jackson & Lewis McCown, the subscribing witnesses thereto & ordered to be recorded.

Present Moses Wickliffe, J.W. Poag, Henry Myers Esqrs.

The Executors named in the last will and testament of Lewis Reno deceased being in court and refusing to qualify as Executors, thereupon the court appointed Charles Morehead Administrator with the will annexed of the said decedent, who thereupon took the oath prescribed by law and together with Andrew Glenn & Raughley Sullivan, his security, executed bond in the penalty of twelve hundred dollars conditioned as the law directs. Ordered that John Stroud, John Baxter, Taylor R. Clark & James W. Poag, or any three of them being first sworn, appraise in current money the personal estate & slaves if any of Lewis Reno deceased & that the Admr. return an inventory thereof as the law directs. The last will and testament of Sarah Bell deceased was exhibited in to court and proved to be the act and deed of the said decedent by the oaths of William Bell and Andrew Craig deceased the subscribing witnesses thereto and ordered to be recorded.

Ordered that Charles F. Wing, George W. Short & Richard Guyn be and they are hereby appointed commissioners to examine & see what repairs are necessary to be made on the jail of this county & have said repairs made, an appropriation therefor having been made at the November term last.

Muhlenberg County Court Order Book 5, Page 188 - January Term 1846

Ordered that Richard Guyn jailor have the privilege of building a smokehouse on the public ground near the jail, that said house be built so as not to obstruct the main view from Main Street or obstruct the alley now open east of the public square and that said Guyn have the privilege of removing said house when he shall cease to be jailor. Charles Tyler, Sheriff of Muhlenberg County, came into court and together with George W. Eaves, John S. Eaves Sr. and John S. Eaves Jr., his security, executed bond in the penalty of ten thousand dollars conditioned as the law directs for the collection of the revenue tax for the year 1846. The same with the same security executed bond in the penalty of three thousand dollars conditioned as the law directs for the collection fo the county levy.

Ordered that summons issue against John McIntosh returnable here at the next court, to show cause why his children may not be bound out as the law directs. [Image]

Thomas S. Kirtley, Plaintiff, against George Vanlandingham, Defendant, on an appeal
This day came the parties aforesaid by their attorneys and after hearing the testimony in the cause and the arguments of counsel, it is ordered that the judgment of the Justice below be reversed & that said Vanlandingham recover of the said Kirtley the sum of ten dollars and also his costs about his defense in this behalf expended & the said Kirtley in mercy &c. but this judgment is entitled to a credit of one dollar & the clker has lien for his costs.

Ordered that the order made at the last term of this court appointing commissioners of the tax for the year 1846 be confimed.

Muhlenberg County Court Order Book 5, Page 189 - January Term 1846

Ordered that Richard B. Earle overseer together with his hands Ashford Randolph, John S. Eaves, Barnabas Wilkins, Thomas C. Summers, Jefferson Martin & William Morgan surveyors with the hands under each of them, open the road lately viewed and marked out to lead from the Rumsey Road leading from Clarks ferry, to Carrolton on Green River, that they open said road & make report as the law directs.

On the motion of Thomas C. Summers, it is ordered that the commissioners heretofore appointed to lay off & set apart to Mrs. Summers her dower in & to the estate of her deceased husband Charles C. Summers deceased be further authorised to divide among the heirs the two thirds of the estate yet remaining & make report thereof.

{cpd.} It appearing to the satisfactino of the court that Jacob Bodine commissioner of the tax heretofore appointed by the court, is permitted to draw from the treasury the sum of twenty five dollars and 82 cents, the twenty percent retained at the June term 1845 after deducting fifty cents for one list not taken[?], he having faithfully performed his duty, which is ordered to be copied & certified to the auditor of public accounts.

Charles Tyler, Sheriff of this county, came into court & nominated Charles Henry Ward as a proper person to act as his deputy and the court took time till next court to consider thereon.

Muhlenberg County Court Order Book 5, Page 190 - February Term 1846

At a county court began and held for Muhlenberg County at the courthouse in Greenville on Monday the 23d day of February 1846

A settlement made with the Administrator of William Luce deceased was again presented to the court and having laid over one term as the law requires is now ordered to be recorded.

Mrs. Ruth Weir, widow of James Weir deceased, by her writing hereto the court shown, requested the court to appoint Edward R. Weir, guardian for her infant daughter Ruth Annette Weir, which writing was proven by the oath of Edward R. Elliott, one of the subscribing witnesses & ordered to be recorded. Whereupon the court appointed Edward R. Weir, guardian as aforesaid who thereupon took the oath prescribed by law and together with Edward R. Elliott, Edward Rumsey & Charles F. Wing, his security, executed bond in the penalty of thirty thousand dollars conditioned as the law directs. [Image]

Indenture of an apprentice between the clerk of this court & Richard Nall was exhibited in to court & being examined & approved is ordered to be recorded.

A note from William B. Smith to Mary Ferguson was exhibited in to court & proved to be the act & deed of the said Smith by the oath of Moses Wickliffe, a subscribing witness & ordered to be recorded.
A Power of Attorney from Mary Ferguson to John R. Jones & George W. Jones was exhibited in to court & proved to be the act and deed of the said Mary by the oaths of Moses Wickliffe & Peter Jones, which is ordered to be certified. [Image]

Muhlenberg County Court Order Book 5, Page 191 - February Term 1846

Ordered that a pleuries summons be awarded herein against the defendant returnable here at the next court to which time this suit is continued

Commissioners for Christopher Tinkle to David Gish bearing[?] a deed was exhibited in to court and proved to be the act & deed of said commissioners by the oaths of John Reed & John Danner, the subscribing witnesses & ordered to be recorded.

The Commonwealth, Plaintiff, against James A. Hunt, Defendant, in bastardy
This day came the as well the attorney for the Commonwealth as the Defendant in discharge of his recognizance, and Margaret Ann Fleming having sworn that James A. Hunt, the defendant, was the father of her bastard child Nancy Jane Fleming and after hearing the testimony and the arguments of counsel, it is considered by the court that the Commonwealth recover of the said James A. Hunt the sum of two hundred & forty dollars payable in six annual installments of forty dollars each for the support & maintenance of said bastart child and that he also pay the costs of this prosecution, whereupon the said James A. Hunt together with Owen Hunt, Jonathan Hunt & Lovet P. Whitney, his security, executed bond in the penalty of five hundred dollars conditioned as the law directs. [Image]

Ordered that Zilman Wood be appointed surveyor of that part of the road leading from Greenville to Bowling Green whereof L.P. Whitney was surveyor & that he with the hands formerly allotted open & keep the same in repair 15 feet as the law directs.

An additional inventory of the estate of John McNary deceased was exhibited in to court by the Executor & ordered to be recorded.

Muhlenberg County Court Order Book 5, Page 192 - February Term 1846

Ordered that Thomas Girvin be appointed surveyor of that part of the public road whereof W.G. Langley was surveyor leading from Greenville to Lewisberg & that he with the hands formerly allotted said Langley open & keep the same in repair 30 feet wide as the law directs.

On the motion of Wilson C. Turner, it is ordered that James Scott, Esram Hendricks, Samuel Whitmer and Andrew Shaver, or any three of them being first sworn, view & mark out an alteration of that part of the road leading from Madisonville to Carrolton as the same passes through the land of said Turner & make report as the law directs.

The commissioners appointed for that purpose reported that they had marked out an alteration of that part of the road leading from Greenville to Hopkinsville as it passes the farm of E. Dukes which report was received, ordered that said alteration be established upon condition that said Dukes open the same as the law requires.

Ordered that John Campbell & Strother Jones Esqrs. be & they are hereby appointed commissioners to settle with Charles Tyler, Sheriff, for the year 1845 & make report as the law directs.

Ordered that
The Commissioners appointed for that purpose reported that they had laid off & set apart to Mrs. Summers her dower in & to the estate of her husband C.C. Summers & the portion allotted the heirs of said decedent, which report was received by the court. Ordered that said commissioners proceed to make conveyance to each as the law directs.

The commissioners appointed to let the building of the bridges across the slews made their report which is filed.

{fee paid} Wyatt C. Collins' stockmark towit a cross & split in the left ear & a hole in the right ear which on his motion is ordered to be recorded.

{fee paid} William J.W. Rices stockmark towit a swallow fork & underbit in the right ear and a underslope in the left each which upon his motion is ordered to be recorded.

On the motion of Tiberius R. Matthews (the widow by her writing having refused to take upon her the burden of Administration) the court appointed him Administrator of the estate of Edward Matthews decd., who thereupon took the oath prescribed by law & together with Charles Bell, his security, executed bond in the penalty & condition as the law directs.

Muhlenberg County Court Order Book 5, Page 194 - April Term 1846

On the motion of Vachel L. Dillingham (Mrs. Juliet G. Warrener, the widow, by her writing refusing to take upon herself the burden), the court appointed him Admr. of James Warrener decd., who thereupon took the oath prescribed by law and together with Barnet Eades & Mathew Oates, his security, executed bond in the penalty and condition of one thousand dollars as the law directs. Ordered that Thos. L. Martin, Saml. M. Wilkins, E.R. Dillingham, Royal Daniels his security [sic] or any three of them being first sworn, appraise in current money the personal estate & slaves if any & that said Admr. return an inventory thereof as the law directs. {fee paid} On the motion of Alexander Campbell, whose bond has expired & a majority being present & concurring therein, appointed and elected him constable in the district in which he formerly acted, who thereupon took the oath prescribed by law and together with Sanders Eaves & Paschal L. Townes, his security, executed bond in the penalty & condition as the law directs.

Martin, who bond as constable has expired (a majority being present & concurring therein), the court appointed him constable in the district in which he formerly acted, who thereupon took the oaths prescribed by law & together with James J. Muhlenberg County Court Order Book 5, Page 195 - April Term 1846

{fee paid} …the same is hereby appropriated for the improvement of said roads, that said commissioners receive & see that said sum is equmenically [sic - ecumenically] expended on said roads.

On the motion of Jesse R. Oates, ordered that John S. Eaves, Isaac Wood, R.B. Earle & Jesse B.E. Oates, or any three of them being first sworn, view & mark out an alteration of that part of the road leading from Greenville to Doges [? - Doziers?] ford on Pond River as the same passes the farm of Jesse R. Oates & that they make report thereof as the law directs.

On the motion of Jonathan Short & a majority of the court being present & concurring therein, it is ordered that the constables bounds within which Benjamin Shaver is constable be so altered & extended to include the present residence of said Shaver.

Ordered that James T. Quisenberry be and he is hereby appointed overseer of that part of the road leading from Greenville to Mortons ferry whereof William Robertson was surveyor & that he with the hands formerly allotted open & keep the same in repair 15 feet wide as the law directs.

Ordered that Robert W. Bodine be appointed surveyor of that part of the road leading from Greenville to Vaughts mill whereof Andrew Glenn Jr. was surveyor & that he with the hands formerly allotted open & keep the same in repair 15 feet wide as the law directs.

Muhlenberg County Court Order Book 5, Page 196 - April Term 1846

… attorney, this case is continued until the next court at the costs of said defts.

Ordered that Robert Eades be appointed overseer of that part of the road leading from Greenville to Madisonville on the road the upper road whereof James Warrener deceased was overseer & that he with the hands formerly allotted open & keep the same in repair as heretofore ordered and as the law directs.

Ordered that James Pate be appointed surveyor of that part of the road leading from Greenville to Lewisberg whereof Thomas Calvert was surveyor & that he with the hands formerly allotted open & keep the same in repair 30 feet wide as the law directs.

Ordered that Andrew Lynn be appointed overseer of that part of the road leading from the Island Ford and Pond River to Rumsey that lies between said ford & Joel Vancleave & that he with the hands formerly allotted together with the hands included in the extension (see it) & that he with the hands included in said bounds open & keep the same in repair 20 feet wide as the law directs.

Inventory & appraisement of the estate of Lewis Reno deceased was returned in to court & ordered to be recorded. Sale bill of the same, same order.

Ordered that Leonard Smith be appointed surveyor of that part of the road leading from Heltsleys Bridge to Williams ferry on Green River whereof Elias V. Kirtley was surveyor & that he with the hands formerly allotted said Kirtley open & keep the same in repair 15 feet wide as the law directs.

On the motion & nomination, it is ordered that Henry Ward be admitted deputy sheriff for Charles Tyler sheriff, who thereupon took the oaths prescribed by law together with the oath against dueling.

Muhlenberg County Court Order Book 5, Page 197 - April Term 1846

Ordered that Joseph L. McIntire be appointed surveyor of that part of the road leading from Carrolton to the intersection of the Madisonville Road whereof J.E. Coleman was surveyor & that he with the hands formerly allotted open & keep the same in repair 15 feet wide as the law directs.

{fee pd.} On the motion of Henry Herin, a man of colour, and satisfactory proof being made to the court that said Henry is a free man being born of a free woman, about twenty six years of age, of copper colour, black hair & eyes & about five feet ten inches high & that he is entitled to all the rights & privileges of any free man of color in these United States, which is ordered to be certified to all whom it may concern. Ordered that Thomas Summers be appointed surveyor of that part of the road leading from Greenville to Madisonville that lies between David James & Isaac Creek Bridge & that he with the following hands John Fletcher, James Irvin & hands, Wm. Irvin, Benjamin Wilson, Robert & David Jones thence John Miller thence to David James's old place, thence to Joshua Stewarts old place including Thomas Tyson open & keep the same in repair 30 feet wide as the law directs.

{fee pd.} On the motion of Dicy Sketoe, orphan of John Sketoe decd., who appeared in court, the court appointed Fredeoline Boehler her guardian, who thereupon took the oath prescribed by law & together with Sanders Eaves, his security, executed bond in the penalty of fifty dollars conditioned as the law directs. Ordered that James Utley be appointed surveyor of that part of the road leading from Greenville to Hopkinsville whereof John Row was surveyor & that he with the hands formerly allotted open & keep the same in repair 30 feet wide as the law directs.

Muhlenberg County Court Order Book 5, Page 198 - April Term 1846

Ordered that Benjamin Jernigan be appointed surveyor of that part of the road leading from Greenville to Morgantown that lies between Greenville & Bear Branch whereof Saml. Ross was surveyor & that he with the hands formerly allotted together with the additional hands & boundary (see them) open & keep the same in repair 30 feet wide as the law directs.

{copd.} On the motion of Britton Edwards and it appearing to the satisfaction of the court that he is a poor person & unable to pay county levy, it is therefore ordered that he be exempt from paying county levy in future. [Image]

Ordered that the precinct of the road leading from Greenville to Hopkinsville whereof Alfred Low is overseer lying between Greenville & Jarrals Creek be divided & that Thomas Norman be appointed surveyor of the first division beginning at Greenville & that Joseph Turner be appointed overseer of the second division beginning at Thomas James's (see bounds) & that they open & keep the same in repair 30 feet wide as the law directs.

On the motion of Isaac H. Ingram & William Harbert, who are desirous of keeping a tavern at their house in Rumsey (a majority being present & concurring therein) who made oath as the law directs, license is granted them to keep a tavern at their house in Rumsey, who thereupon together with Sanders Eaves, their security, executed bond in the penalty and condition as the law directs.

Jacob Langs [sic], late constable in & for the town of Greenville, came into court and resigned as such. Whereupon the court, a majority being present & concurring, appointed Southall Turner constable in the district in which said Lands [Landes] formerly acted, who thereupon took the oaths prescribed by law, and together with John C. Gibbs,…

Muhlenberg County Court Order Book 5, Page 199 - April Term 1846

…Samuel Turner & B.E. Pittman, his security, executed bond in the penalty & condition as the law directs.

Ordered that James Martin, Grgisby Metzker and John Lovell, or any three of them, be & they are hereby appointed patrollers in & for the town of Greenville & that they serve as the law directs.

Ordered that R.S. Russell & John Campbell be appointed Judges to the election for Trustees of Greenville for the ensuing year.

Ordered that this suit be continued until court the next court, and it is further ordered that an attachment be awarded herein against Charles M. Baber Esqr., requiring the sheriff to take bail of him in the sum of fifty dollars for his appearance at the next court & that he bring the necessary papers in his office relative to the above case.

On the motion of Isaac Wood (the widow being present & consenting) the court appointed him Administrator of the estate of John Cash deceased, who thereupon took the oath prescribed by law & together with John S. Eaves, his security, execued bond in the penalty of two hundred dollars conditioned as the law directs. Ordered that Gillis Mercer, Isaac Malone, Barnabas Wilkins & James Arnett, or any three of them, be & they are hereby appointed appraisers of the estate of said decedent (being first sworn), that they appraise the personal estate & slaves if any & that the Admr. make & return an inventory as the law requires.

Settlement with William Bell, curator of W.H. Bailey, ordered to lie over.

Settlement with the Admr. of John Clark deceased, ordered to lie over till next court.

Report of processioners of the lands of James Nicholls, returned & ordered to be recorded.

Ordered that Robert J. Cessna be appointed surveyor of that part of the road leading from Greenville to Lewisberg whereof Thomas J. Anthony is surveyor & that he with the hands formerly allotted him open & keep the same in repair 30 feet wide as the law directs.

Ordered that David Peregrin be appointed surveyor of that part of the road leading from Everlys ferry to Madisonville that lies between said ferry & Cypress Bridge, whereof Simeon Everly was surveyor & that he with the hands formerly allotted open & keep the same in repair 15 feet wide as the law directs.

Orderd that John S. Duvall be appointed surveyor of that part of the road leading from Greenville to Elkton whereof James B. Hancock was surveyor & that he with the hands formerly allotted open & keep the same in repair [blank] feet wide as the law directs.

Ordered that Eli Johnson be appointed surveyor of that part of the road leading from Greenville to Hustons ferry that lies between the middle of the Thoroughfare & said ferry whereof John Gish was surveyor & that he with the hands formerly allotted said Gish & Jno. A. Towns open & keep the same in repair 15 feet wide as the law directs.

Ordered that A.M. Tolbert be appointed overseer of that part of the road leading from the Russellville Road to Fersts mill whereof Joseph…

Muhlenberg County Court Order Book 5, Page 201 - April Term 1846

…Jones was surveyor and that he with the hands formerly allotted open & keep the same in repair 15 feet wide as the law directs.

Ordered that Joseph Noftsinger be appointed surveyor of that part of the road lying between James Scotts & John Noftsinger & that he with the hands in the following bounds (see them) open & keep the same in repair 15 feet wide as the law directs.

On the motion of Leonard Smith, it is ordered that Moses Glenn, Elias Kirtley, Daniel Kitting [sic - Kittinger]& Abington Yonce [Yonts], or any three of them first sworn, view & mark out an alteration of that part of the road leading from Heltsleys Bridge to Williams ferry as it passes or near the farm of Mrs. Heltsley & report the conveniences & inconveniences of the old & new way as the law directs.

Ordered that the following precinct of the road leading from Greenville to Daviess ferry be established as follows Beginning at the ferry thence to H.B. Gardners thence to J. Wilsons thence to J.J. Hunts thence to John Hunt Sr. thence to George Mefford thence to the beginning so as to include Owen Hunt & that the present overseer Gasham Davis open & keep the same in repair 15 feet wide as the law directs.

Satisfactory evidence being adduced to the court in open court to prove that James Pate, Philip Pate, William Pate, Mary Curtis & Rachel Pate are the only surviving heirs of at law in fee of the late John Pate, who was an enlisted solider of the United States in the war of 1812, that said John Pate enlisted in the state of [blank] Carolina and served out the full period of his enlistment, & that he died in the state of Kentucky in the year 1837. It was also proved in open court that said John Pate was born in the state of [blank] Carolina, was about 25 years old when he first enlisted, about 6 feet 2 inches high, black hair & light hazel eyes, fair complexion & spare made and was by occupation when he enlisted a labourer or farmer, which is ordered to be certified. Southall Turner came in to court & resigned as constable in the town of Greenville, said Turner offered his resignation at the last term but the order was omitted & is now made nunc pro tunc.

{copd. T.J. Anthony} Ordered that Edward R. Weir, county treasurer of this county, pay in to the hands of Charles Morehead, John W.I. Godman & Thomas J. Anthony, or either of them, the sum of two hundred dollars, the sum appropriated at a former term of this court for repairing the roads leading from Greenville to Lewisberg & from Carrolton in a direction to Madisonville, that he pay the same to the said commissioners out of money in his hands due the county.

On the motion of Reuben Arndell who made oath as the law directs, certificate is granted him for obtaining letters of administration on the estate of Nathan Arndell deceased, who thereupon together with Richard H. Simmons, his security, executed bond in the penalty of two hundred dollars conditioned as the law directs.

Ordered that I.J. Baker, Daniel Kimmel, Harvey Young & William Wester, or any three of them being first sworn, appraise in current money the personal estate and slaves, if any, of Nathan Arndell deceased & that the Administrator return an inventory thereof as the law directs.

Ther persons appointed for that purpose having made their report for opening the road leading from Vickers Bridge to Rumsey at the August term last, and Ezekiel Fleming the proprietor of the land through which said road was viewed being present in court & consenting thereto, it is ordered that said road be established accordingly and that Daniel Plain be appointed surveyor thereof and that he with the hands formerly allotted open & keep the same in repair 30 feet wide as the law directs.

Simmons, his security, executed an additional bond in the penalty of seven hundred dollars conditioned as the law directs as the Administrator of Aaron A. Smith deceased, the said Rhoads being security in the first bond.

Ordered that Moses Wickliffe, Robert S. Russell & James W. Poag or be and they are hereby appointed as proper persons to grant injunctions, writs of ne exeat &c. as the law directs.

A majority of all the Justices in commission of the peace in & for said county being present & concurring therein, recommend to his Excellency the Governor, John Campbell & Strother Jones Esqrs. as proper persons one of whom to be commissioned Sheriff for this county in place of George W. Charles M. Baber Esqr. having failed to attend the last term of this court, being court of claims, came into court and offered his excuse which was sustained by the court.

The last will and testament of James Wood Sr. decd. was exhibited into court and proved by the oath of Abner Wood, a subscribing witness thereto, and ordered to be certified.

Satisfactory proof was adduced in open court to prove that Joseph Walker is the only surviving heir at law in fee of the late James Walker, who was an enlisted soldier of the United States for the period of five years during the in the war of 1812, that he enlisted under Liet. [blank] the [blank] regiment of infantry and died before he ever returned home, that said James Walker was born in the state of [blank] was about 47 years of age at the time of enlistment, 5 feet 8 inches high, blue eyes & light hair and was by occupation when enlisted a farmer & school teacher. On the motion of Elijah Wilkins and Jackson Wilkins, who made oath as the law directs, certificate is granted them for obtaining letters of administration on the estate of James Wilkins Sr. decd., who thereupon together with David Evans and Timothy Humphrey, their security, executed bond in the penalty of $1200 conditioned as the law directs.

The commissioners appointed for the purpose of letting a stray pen for this county reported that they had let the same to Richard Guyn for the sum of $12, who thereupon give bond with Jesse H. Reno, his security, in the penalty of $51 which is ordered to be filed. [Image]
