Transcription

The last will & testament of Stephen Wilcox. Item the 1st, I devise that all my just debts be paid & satisfied bequeath my [sic]

[Item the 2nd,] I wish [that my] dear & well beloved wife Susan Wilcox to have one horse & two cows of her own choosing. Also I beqeath her all my household furniture including beds & furniture, cupboard ware &c. Also all my kitchen furniture. I also wish her to have hogs enough to make meat for her & my dear children for 12 months & corn for the length of time.

Item the 3rd, I give to my son David J. Wilcox all my lands subject to my wife's dower right in the land on which I now live during her liftime or widowhood.

Item 4”, I give to my other children towit, Kitty Ann & Juley Ann (now it being known that my wife Susan is in a family way, if it should come & live name &nbps; nbsp; nbsp; nbsp; nbsp; three in number) all my property, after debts & expenses & articles above named take out, to be equally divided among the said three towit, Kitty Ann, Juley Ann & name[less child].

Item the 5th, I wish all my children Killy Ann, David J., July Ann & name[less child] to have good, common scholling out of the proceeds of my property.

Item 6”, I do hereby appoint W.S. Hay exr. to this my last will & testament to sell all my loose lunder & pay my debts 7amp; then divide as above named.

In testimony whereof I have here set [my] hand & seal this 1st day of July 1844.

The foregoing last will & testament of Stephen Wilcox decd. was exhibited into court by the exr. therein named and proved to be the act & deed of sd. Stephen Wilcox by the oaths of Wiley S. Hay & Joshua Benton, the subscribing witnesses thereto, & ordered to be recorded.
In testimony that the same has been truly recorded, I hereunto set my hand.
