Miles Cary, 1843
Know all men by these presents that I Miles Cary of the county of Muhlenberg and Commonwealth of Kentucky, in the name of God Amen, being in a low state of health but of sound mind and disposing memory, and calling to mind the uncertainty of life and certainty of death, and wishing to dispose of the thigs of this world with which the Lord has blessed me, and having a desire to dispose of of it as I wish, to make this my last will and testament as followeth, towit.
I will and bequeath, first, that all my just debts be paid.
2nd that my beloved wife Temperance shall have all my tract of land where I now live on during her natural life also all my negroes & their increase, household and kitchen furniture, farming tools, and all my stock but that part which shall be otherwise herein directed or advised also my waggon & gear during her natural life.
3rd I give to my son Lock A. Cary all my land estate lying on the north side of Long Creek.
4th I give to my son Francis L. Cary two tracts of land, one of fifty acres known by the name of the Thomas Davis plance and twenty five acres lying adjoining the same, also give my son F.L. Cary all my farm and land where I live at the death of my wife also give my son F.L. Cary at the death of his mother my waggon and gear.
5th I give to my daughter July A. Cary one horse to be worth thirty dollars, one bed and furniture and cow and calf.
6th I give to my daughter Permela C. Cary one horse worth thirty dollars, one bed and furniture, and cow and calf.
7th my will is that at the death of my wife that all my negroes and their increase with all species of personal property be sold, and equally divided amongst all my children except my daughter Nancy. My negroes only to be purchased by the children, and no other person.
8th my will is that at that death of my wife that Francis L. Cary retain in his hands one sixth of the proceeds arising from the sale of negroes and personal estate for the use and benefit of Nancy Grace's; children to be divided equally among them, and paid to them by said F.L. Cary as they arise as the age of twenty one years.
Whereas James Wells having had eighty dollars more than any of the rest of the children, my will is that at the death of my wife that he account for that amount the division.
My will is that in case of any of my children departing this life without heirs of their own body that their portion revert back to my heirs.
I appoint Lock A. Cary and Francis L. Cary executors to my foregoing will. April the 25th 1843.

The foregoing last will and testament of Miles Cary deceased was exhibited into court and proved to be the last will and testament of said Cary by the oaths of M.P. Wells and Alden Bass the two subscribing witnesses thereto which is thereupon ordered to be recorded.
