Transcription

I, Benjamin W. Cundiff, being of sound in mind do make this my last will and testament hereby revoking any and all former wills made by me.

First, I give and bequeath unto my beloved wife Mary G. Cundiff all of my property both real, personal, and mixed, to be held by her during her natural life.

Second, after the death of my wife, I desire all my property (except the land hereinafter mentioned) be divided equally between my son Jefferson D. Cundiff and my daughter Mary L. Cundiff (I have heretofore given my other children some property which I desire to be in lieu of their part of my estate).

Third, after the death of my wife, I give to my son Jefferson D. Cundiff the tract of land on which I now live but I desire that my daughter Mary L. Cundiff have a home on it as long as she lives.

Fourth, I hereby appoint my son Jefferson D. Cundiff my executor of this my last will and testament.

Witness my hand this the 16” day of July 1883.

The foregoing last will and testament of Benj. W. Cundiff, deceased, was produced in open court on the date aforesaid and proven to be the act and deed of said decdent by the oath of Lewis Reno, one of the subscribing witnesses thereto, who also testified to the signatures of W.T. Stiles and M.C. Hay, the other two subscribing witnesses thereto. Whereupon the same is adjudged to be the last will and testament of said decedent and ordered to be recorded which is now done accordingly.
