John Cundiff, 1836

Muhlenberg County Kentucky January 28th 1836. A few days before the death of John Cundiff [I] was with him at his own house, he being very low in health But I believe of sound mind and memory, said it was his wish and desire that all his Estate Both Real and personal should be kept together for the use of his wife, Nancy and their children during her natural life or widowhood and if she should marry, a division would be necessary and that he had given the children he had by his first wife what he allowed them and had a clear receipt from them and that his son Bryant owed him thirty one dollars and five shillings which he wanted me to collect for the use of his family.

The within subscribing witnesses Bryan Y. Cundiff and Margaret Cundiff came before me Solomon Rhoads a justice of the peace for Muhlenberg County and made oath that they was both present when John Cundiff, the within named, a few days before his death, requested the contents of the within note and we believe he was in Sound Mind and perfect memory when he ordered the within written and acknowledged the same to be his last Will. Given under my hand this 4th day of February 1836.

The foregoing Nuncupative will of John Cundiff deceased was exhibited into court which together with the certificate of Solomon Rhoads Esqr. thereon endorsed was ordered to be recorded.
