In the name of God, Amen. I, Andrew Kittinger, being bodily afflicted, tho of sound mind & memory & knowing the uncertainty of life & the certainty of death, do make this my last will & testament.
Item first, It is my will that all my just debts be paid first out of my estate.
Item second, Whereas my wife Amnday Ann at her death beind ceased & possessed of three hundred & twenty eight dollars in her own right which she desired should be distributed as follows.
To John E. Kittinger one hundred dollars in greenbacks.
To Eliza J. Kittinger one hundred dollars in gold.
To Daniel K. & Leonard S. Kittinger the remainder equally divided.
Now these four children being our youngest, it is my will that distribution be made according to her desire as above.
Item third, It is my will that after my death that my children should remain together upon the farm as much as possible and that my son Jacob remain with them as their guide & director & that they may be able to make a sufficient support.
it is my wish that the following articles be reserved for the use of the farm. The new wagon & two mules & horses. The mowing machine. Two 2-horse ploughs and two 1-horse ploughs with other impliments & tools as my son Jacob may consider necessary for the use of the fmar. Also two cows, 12 head of sheep & my present stock of hogs, also my household & kitchen furniture or so much thereof or so much thereof [sic] as Jacob may consider necessary for the family. Also 6 bedsteads, and all the remainder of perishable property be sold at public auction.
Item fourth, It is my will that Jacob remain with the family till the youngest child is of age & that he have for his care and service on the farm all the surplus products over and above a support till the youngest child is of age, at which time I wish all my land & other property sold & the proceeds of the same equally divided between my living children or their representatives. Those now living are Jacob, Ellen Eades (late Kittinger), George A., John E., Daniel K., Eliza J. & Leonard S. Kittinger.
Item fifth, By an agreement with Jacob for his service on the farm, this present year I am to pay him one third of the coming 5 acres of oats & hay sufficient to winter his horse & two fifths of the tobacco. Now in case of my death before the close of the year, I wish to leave the matter with Jacob that instead of the above contract that he take for his portion the surplus over and above a support of the family as before provided.
Item the 6th, my son George now living in the Martin Kittinger Houses is not to be charged with rent for the same or the ground thereto pertaining by which I mean the lot around the house, and as long as he remains, he is to cultivate the tobacco barn field & as much more as he may claim free of rent.
Item the 7th, I hereby nominate & appoint Jacob S. Kittinger (my son) executor of this my last will. Given under my hand this 10th day of May 1870.

The foregoing last will and testament of Andrew F. Kittinger decd. was produced to Court and proved to be the act and deed of the said Andrew f. Kittinger decd. by the oaths of John B. Frost & B.W. Woodburn, two of the subscribing witnesses thereo, who also proved the attestation of P. Briscoe, the other subscribing witness, and the same is ordered to be recorded which is accordingly done.
