Lott Penrod Will & Mary Penrod Renouncement
I, Lott Penrod of the County of Muhlenberg and State of Kentucky being sound in mind though feeble in body, make and publish this my last will and testament towit
First, It is my wish and desire that all my just debts be paid and that I be decently buried.
Second I bequeath and will to my beloved wife Mary A. Penrod my entire farm upon which I now live with all the stock and farming utensils of all kinds during her natural life or widowhood. She is to take and educate and raise all of my newer heirs from the proceeds of same but of that should prove insufficient to cloth, raise, and educate them, then my executor is to furnish the necessary means from my Estate if in his judgment, it is for the good of my children to do so. And I furthermore wish and desire my two sons John and William remain on the farm and work and carry on the same for the benefit of themselves and the rest of my newer heirs under the supervision of my executor and John is to have one fourth of the present years crop of Tobacco and he is to gether and house the entire crop and prepare the Tobacco for market and he is to have a horse bridle and saddle at the end of this year and William if he remains until he is twenty one years of age is to have a horse bridle and saddle and feather bed but if either of them should not comply with the above request they are not to have said articles. I also will to my wife three Hundred Dollars in money to do with as she may see proper.
Third I will and bequeath to my daughter Hernettice M. James & her heirs, the tract of land purchased by me of Thomas Wood, which is to charged to her in the distribution of my estate at eight hundred Dollars. I also will to my son John the tract of land Known as the Abe Billings place which is to be charged to him at eight hundred Dollars, also to my son William I will the land Known as the John Williams which is to be charged to him at eight hundred Dollars, but neither of the Boys are to have possession of or any controls of the land until they are twenty one years of age.
Fourth, I also hereby empower my executor in conjunction with my wife to sell and convey any or all of my land not embraced in the above bequests for the benefit of my younger children on time so as to make the payments come in as they may need it or become of age and sell at such prices as they may think just and right.
Fifth, It is my wish and desire that in the final settlement and distribution of my estate that all of my heirs be made equal in the same and if there is not enough to make the younger children equal with Hernettice, John and William, each shall pay back her or his proportional part to make them equal.
Sixth I hereby appoint H.G. Newman my executor to carry out the provisions of this will and to advise with and superintend all of my wife's affairs on and about the farm and in management of the children and I ask the court to take his bond for his executorship without any security. To all of which I hereby subscribe my name and set my seal this the 14th day of April 1874.
