Commonwealth Versus Duncan Green} Idiot

This day Geo. Batterton, Attorney for the Commonwealth, filed an information as follows, to-wit: To: Robt. L. Stout, Judge of the Bourbon Circuit Court: I am reliably informed that Green Duncan is a person of unsound mind and a lunatic and therefore ask that a Jury be impaneled to pass upon the subject.

Ordered by the Court, That P. A. Thompson Esq., an Attorney of this court, be and he is hereby appointed to defend for and on behalf of the person under trial.

To inquire, etc., comes a jury to-wit: J. S. Douglas, A. D. Leach, H. L. Clark, D. S. Henry, Wm. Travis, J. T. Kiser, U. Bedford, Ami Dnsey, Joe, Leach, Owen Kennedy, Gates Rice, and A. T. Henry who being duly impaneled and sworn according to law, after hearing the evidence, returned the following verdict, viz: We of the Jury find the evidence that Duncan Green is a person of unsound mind and a lunatic. That the unsoundness of mind has existed since ______; that he was born in Bourbon Co., Ky. And resides in Bourbon Co., Ky. County, and is 49 years of age; that he was not brought into this State for the purpose of becoming a charge upon the Commonwealth; that he owns _______ no estate of any kind; that father is dead and mother is dead and he has not estate sufficient to support the person under trial; and said Green Duncan is not capable of laboring either in whole or in part for his support.

Together with whatever else may be deemed material toward enabling the superintendent of the asylum to understand the case

Wherefore it is adjudged by the court that said Green Duncan is a person of unsound mind and a Lunatic; it is ordered that __ he be committed to the asylum for the insane at Lexington, Ky., and that the superintendent of said asylum be immediately notified and directed to send for said lunatic.

Crump who being duly impaneled and sworn according to law, after hearing the evidence, returned the following verdict, viz: We of the Jury find the evidence that Jessie Owens is a person of unsound mind and a lunatic. That the unsoundness of mind has existed since 12 months past; that he was born in Kentucky. Bourbon County and resides in Bourbon County, and is 34 years of age; that he was not brought into this State for the purpose of becoming a charge upon the Commonwealth; that he owns nothing, no estate of any kind; that father is yes and mother is living and he has not estate sufficient to support the person under trial; and said Jessie Owens is not capable of laboring either in whole or in part for his support.

The affiants, Dr. W. C. Ussery and Dr. F. L. Lapsley, state that they are regular practicing physicians at Paris, Kentucky, and have been such for many years: that they have personally examined the above named defendant, Jesse Owens, of Paris, Kentucky, charged to be of unsound mind, and that they verily believe him, the said, Jessie Owens, to be a person of unsound mind, and that his condition is such that it would be unsafe to bring him to court.

Whereas, it is charges that Jessie Owens, of Paris, Kentucky, is a person of unsound mind, and an application has been made for an inquest to inquire into the mental condition of the said Jessie Owens, of Paris, Kentucky; now, therefore, you are commanded to summons the said Jessie Owens to appear in the Bourbon Circuit Court on the 18th day of November, 1915. At the hour of 2:00 P.M., when and where an in will be held concerning, and you will make due return of this summons at the time and place above stated.

Stout, Judge of the Bourbon Circuit Court: I am reliably informed that Amy Saules is a person of unsound mind and a lunatic and therefore ask that a Jury be impaneled to pass upon the subject.

County, and is 70 years of age; that she was not brought into this State for the purpose of becoming a charge upon the Commonwealth; that she owns no estate of any kind; that father is dead and mother is dead and she has not estate sufficient to support the person under trial; and said Amy Saules is not capable of laboring either in whole or in part for her support.
